House approves report of joint select committee on Firearms Act Loop Jamaica

The House of Representatives recently approved the report and recommendations of the Joint Select Committee on the Firearms (Prohibition, Restriction and Regulation) Act (2022).

The Report outlines the recommended changes to the Bill, following the review and deliberations of the Joint Select Committee.

“Having regard to the number of amendments, it is proposed that the original Bill that was tabled on February 10, 2022, be withdrawn and a new amended Bill be tabled,” Deputy Prime Minister and Minister of National Security, Dr Horace Chang said.

The Joint Select Committee completed deliberations on the Bill on July 22, 2022, having received comments from several stakeholders, including the Jamaica Defence Force (JDF), Proactive Jamaicans, Jamaica Rifle Association, the Jamaica Bar Association, the Law offices of Peter Champagnie QC, the Licensed Firearm Holders of Jamaica (LIFE-JAM), Cornwall Bar Association, among others.

He said firearms are the weapons of choice for criminals and criminal organisations operating in Jamaica.

“It could be described as the weapon of mass destruction in this country. These organised criminal groups seek respect by causing fear and creating terror in communities that are hostage to these criminals,” he argued.

Dr. Chang said the current legislative framework, that is the Firearms Act, 1967, provides no disincentive or very little disincentive for criminals and those who support their activities, to hand over illegal guns.

He noted that the Bill, which was sent to the Joint Select Committee, proposed the introduction of harsher penalties for certain offences, such as the possession of a prohibited weapon with intent to traffic and the manufacturing of a prohibited weapon.

“For these more egregious offences, the Bill proposes imposing a mandatory term of imprisonment for 15 years before eligibility for parole,” he said.

He pointed out that the Joint Select Committee, in reviewing the Bill, made recommendations for introduction of new terms such as “assorted parts”. Additionally, the Committee proposed amendments to the definition of some terms, including “modification”, “firearms”, “parts” and “components”.

The Committee agreed that the definition of the term “firearm” should be amended to read as follows:”(a) means any – (i) barrelled weapon which discharges or is designed to discharge any shot, bullet or other projectile; or (ii) prohibited weapon, unless the context otherwise requires and includes any such weapons created as 3D printed weapons or otherwise created through the use of electronic software; (b) includes any parts and components of any weapon referred to in paragraph (a); and (c) does not include an air rifle, air gun, or air pistol, of a type or calibre prescribed by the Minister.”

“We have done some future-proofing work to ensure that 3D-printed firearms come under the prohibited weapons; it’s a new technology, it’s evolving, and this wording has to be so structured that even if there is changing software… that any weapon that comes through an electronic software in the virtual space and is then manufactured by any kind of machine tool is still a prohibited weapon,” Dr. Chang said.

He said in reviewing the Bill, the Committee made recommendations in respect of the penalty provisions that are provided for in the Bill, whether in Part II or the Sixth Schedule.Importantly, he said the Committee deliberated on the provision of mandatory minimum sentences for the offences outlined in Part II of the Bill, which are considered especially egregious.

Dr. Chang noted that while there was strong and varied discourse surrounding the introduction of mandatory minimum sentences, these penalties were retained in light of the grave situation the country is in at this point in time.

He said the widespread possession and use of illegal firearms and ammunition, and the low sentencing for firearm-related offences underscore the urgent need to strengthen the legislative framework.

“We must implement a more robust enforcement mechanism. We have to establish penalties that are commensurate with the egregious nature of offences connected to the possession and use of unregulated firearms, unregistered firearms,” he said.

Dr. Chang informed that the vast majority of murders in Jamaica are being committed with illegal guns. “The data show that for the four-year period 2018 to 2021, some 2,700 firearms and more than 44,000 rounds of ammunition were seized by law-enforcement agencies,” he said.

Leader of the Opposition, Mark Golding, said it is hoped that the Bill, when passed, will have a positive impact in reducing the number of murders and injuries caused by illegal firearms.

The Firearms (Prohibition, Restriction and Regulation) Act, 2022 seeks to repeal and replace the Firearms Act of 1967, which will make it much more relevant and address the current situation.

The Bill establishes a dual regime, distinguishing between prohibited weapons or unregulated firearms and activities connected thereto, such as illicit trafficking, diversion manufacture, stockpiling, possession; and firearms that are duly authorised or registered with notable improvements for the regulation and enforcement of the firearms industry.

It also introduces new provisions to address Jamaica’s adherence to international treaty obligations as well as the inadequacies that exist in the local framework. It further provides for the marking of firearms, capturing of ballistic signatures as well as the establishment of a National Control System and a National Registry.

The Jamaica 60 Emancipation and Independence thanksgiving Church Service will be held on Sunday, July 31 at 9:00 a.m., at the Boulevard Baptist Church, 2 Washington Boulevard, Kingston 20.

The Government, through the Ministry of Culture, Gender, Entertainment and Sport, will be hosting the service under the theme ‘Reigniting a Nation for Greatness with Gratitude, Discipline and Commitment to God’.

Portfolio Minister, Olivia Grange, will bring greetings at the service, which is expected to be attended by Prime Minister, Andrew Holness and the Hon. Steadman Fuller, Custos of Kingston, representing the Governor General, His Excellency, Sir Patrick Allen. Also attending the service will be Phillip Paulwell, representing Leader of the Opposition, Mark Golding.

Guest preacher will be Bishop Dr. Delford Davis. while the host pastor is Rev. Dr. Devon Dick.

The service will be streamed live on the Jamaica Information Service, the Jamaica Cultural Development Commission, (JCDC) and the Public Broadcasting Corporation of Jamaica (PBCJ) social media platforms.

Acting Production Manager and Coordinator for National Church Services of the JCDC, Andrea McCurdy, told JIS News that a highlight of the service will be the reading of a poem written by the Poet Laureate of Jamaica 2021-2024, Olive Senior, for the Jamaica 60 celebrations.

Ms. McCurdy said that the poem will be read during a special sand-pouring ceremony, which will feature three persons of different generations, who will pour sand depicting the colours of the national flag into a special vase.

“It promises to be an excellent service,” she added.

Ms. McCurdy said that there will be special performances from Gospel Music Minister, Latoya Hall-Downer and the Boulevard Baptist Church Choir.

La Uniformada explicó que Sánchez Caraballo mide 5 pies y 6 pulgadas de estatura, unas 175 libras de peso, de tez clara, ojos marrones y cabello marrón.

Éste fue visto por última vez en Parque de Hato Nuevo en Gurabo a bordo de un Toyota Corolla blanco con tintes.

Hacienda envía sobre 7,000 notificaciones a ciudadanos que recibieron ingresos que no reportaron o que no figuran como contribuyentes bonafide

El secretario del Departamento de Hacienda (DH), Francisco Parés Alicea, instó el viernes, a los comerciantes que no están registrados en SURI y a individuos que recibieron ingresos y no radicaron planillas de contribución sobre ingresos correspondientes al año 2021, a ponerse al día con sus obligaciones y evitar acciones de cobro.

“Continuando con nuestros esfuerzos de fiscalización, estamos enviado 7,500 notificaciones a comerciantes e individuos que no están registrados en el Departamento o que a esta fecha no han notificado ingresos que constan en nuestros registros, para que cumplan con sus obligaciones fiscales y contributivas y así evitar gestiones de cobro y el pago de intereses, recargos y penalidades. La tecnología nos da acceso a un panorama amplio y podemos identificar ingresos generados que no han sido informados”, dijo el funcionario en comunicación escrita.

En el caso de individuos que cuentan con usuario y contraseña en la plataforma SURI, Hacienda les envió el documento ‘Resumen de W2 y Declaraciones Informativas’, con el propósito de mantenerlos informados sobre los formularios que se han recibido bajo sus números de Seguro Social y verifiquen si todos fueron incluidos en sus planillas o de lo contrario realicen las gestiones correspondientes para enmendar sus planillas.

A los contribuyentes que no tienen cuenta en el sistema, se les está enviando la comunicación a través del correo postal. Se enviaron cartas a 2,500 contribuyentes que aún no han radicado su planilla y no han solicitado prórroga para la misma.

De igual forma, explicó que del total de notificaciones, las restantes 5,000 son requerimientos de registro a comerciantes que solicitaron un número de identificación patronal al Internal Revenue Service (IRS por sus siglas en inglés), pero que al día de hoy no aparecen registrados en los sistemas de Gentax o SURI, del Departamento de Hacienda.

“En la comunicación le estamos solicitando a este grupo de comerciantes que se registren en la plataforma SURI y que soliciten su Certificado de Registro de Comerciante, para validar su estatus de contribuyentes. También les estamos informando sobre la penalidad a la que podrían estar sujetos, en caso de no cumplir con este requisito de ley”, declaró.

El Código de Rentas Internas de 2011, establece que negocios que no cumplan con sus obligaciones fiscales y contributivas, pueden enfrentar penalidades de hasta 10,000 dólares, por no registrase en el Departamento y no tener el Certificado de Registro de Comerciante.

“Los trabajos de fiscalización que estamos realizando no se limitan a casos que representen grandes cantidades de dinero. Estamos atentos a todos los niveles de cumplimiento para que la carga contributiva esté distribuida como corresponde y hacerle justicia a los que cumplen rigurosamente con sus obligaciones contributivas”, dijo Parés Alicea.

Agentes de la División de Personas Desaparecidas del Cuerpo de Investigaciones Criminales (CIC) de Ponce, buscan a una mujer de 57 años de edad que desapareció el día 26 de julio del año en curso, de los predios frente a su residencia de la calle Rosal, barrio Quebradas Guayanilla. 

Maribel Filión Jusino, fue reportada desaparecida por su hijo, Jessy Cruz. 

Filión Jusino, fue descrita como de 4 pies 11 pulgadas de estatura, 135 libras de peso, tez blanca, ojos color marrón y cabello negro. Además, se informó que tiene cicatrices en la frente del área de la cabeza y una condición conocida como Pterrigion en un ojo, que es visible. 

Al momento de su desaparición, vestía pantalón corto color negro una blusa color crema y se encontraba descalza y allí una vecina visualizó montándose en el interior de un vehículo marca Ford modelo Explorer color blanco en el lugar antes mencionado, se desconoce tablilla de la misma.

Deux nouveaux homicides cette nuit en Martinique

Les pompiers sont d’abord intervenus à Sainte-Anne pour un quinquagénaire, blessé à l’arme blanche, qui est décédé sur place. – FA

Deux hommes sont décédés cette nuit (du 29 au 30 juillet), l’un à Cap Chevalier à Sainte-Anne d’une blessure par arme blanche et un second par balle au niveau de Pont de Chaîne à Fort-de-France. Toujours à Fort-de-France, un homme a été blessé par balle à la Pointe Simon. 

La soirée avait tristement débuté ce vendredi 29 juillet. Aux alentours de 19h30, les pompiers sont intervenus pour un homme de 56 ans blessé par arme blanche à Sainte-Anne, à Cap Chevalier. Touché au thorax, il est décédé sur place. Quelques heures plus tard, vers 2h55 ce samedi 31 juillet, les secours sont intervenus cette fois-ci à Fort-de-France, route de Balata, face à la station-service de Pont de chaîne. Un homme de 25 ans environ touché par balle au milieu du dos est décédé peu de temps après. 

17e et 18e homicides depuis le début de l’année

Les pompiers ont également pris en charge, vers 22h30, un homme de 35 ans blessé par balle à la cuisse, au niveau de la Pointe Simon, toujours à Fort-de-France. Conscient lors de sa prise en charge, ses jours ne sont pas en danger.

Après le double homicide à la cité Ozanam à Schoelcher et le décès par balles d’un Saint-Lucien de 38 ans à Fort-de-France en juillet, il s’agit des 17e et 18e homicides commis depuis le début de l’année sur le territoire.

Former Minister of Works charged in Magistrate’s Court

The Commissioner of Police, Chester Williams, in an interview this morning said that he was told that former Minister of Works, Rene Montero, who represented the Cayo Central constituency during the previous Barrow administration (UDP),  was “on his way” to Belize and would be handed over to police by his attorneys upon his return to the country. He further noted that police had been informed by Montero’s attorneys that he would be answering to the charges of “willful oppression” brought against him. And he stated that as soon as Montero was turned in, police would be proceeding “with the matter against him”. It is now being reported that Montero has in fact re-entered the country and was arraigned today in the Belmopan Magistrate’s Court, where he met bail of $20,000. The matter was reportedly adjourned until October 24.

Montero, who reportedly arrived at the Philip Goldson International Airport on Sunday evening at 5:00, reportedly had to surrender his passport after receiving bail. 

In September 2021, a warrant was first issued for the arrest of Montero and one George Andrews. It called the former Minister of Works to answer to charges under sections 284 and 309 of the Criminal Code. That section of the law states, “A public officer…is guilty of wilful oppression…if he wilfully commits any excess or abuse of his authority to the injury of the public or of any person.”

Subsequently, on April 25, 2022, it was reported that a Red Notice, which had a publication date of March 2, 2022,  had been issued by the International Criminal Police Organization (Interpol) for the detention of Montero, Sr., and had deemed Montero an escape risk. An AMANDALA article dated April 25, 2022 had reported, “Police have sought—to no avail—to detain the former Minister on the charge of Willful Oppression after it was found that he had willfully abused his authority. According to Belize’s Constitution, any public officer or juror found guilty of the aforementioned crime is liable to be sentenced to two years of imprisonment.”

The Red Notice, which had featured Montero’s photo and listed other details that could be helpful in identifying him, had indicated that, upon the former minister’s arrest, immediate extradition would be sought.

Montero, who served for 12 years under the Barrow Administration, first became the possible subject of a criminal investigation in January 2021 after Minister of Infrastructure Development and Housing, Hon. Julius Espat made a complaint to the Belize Police Department about what he referred to as Montero’s “prolonged abuse and misuse of public resources”. It is being alleged that Montero used public resources, including expensive equipment belonging to the Ministry of Works, to develop properties that belonged to him and his friends and family members. Within a month, a police report had been delivered to the Director of Public Prosecution (DPP), the Integrity Commission, and the Commissioner of Police for review. A few months later, in September, police issued an official warrant for Montero’s arrest.

Following the issuance of the warrant, the chairman of the United Democratic Party had dismissed the charges as unfounded and as an attempt to embarrass the former minister. He had further indicated that Montero had not fled the country, as had been reported, but was in fact visiting the United States for medical reasons and would be handing himself over to the police upon his return to the country.

“Rene Montero called me from the United States yesterday and said that he’s there for medical purposes and as soon as he’s done with that he’s going to come right back and face some willful oppression, some obscure charge in the Criminal Code that says that sometime between 2016 and 2020 he committed willful oppression,” Peyrefitte had said.

One of Montero’s attorneys, OJ Elrington, had stated something similar—that the effort to locate and arrest Montero was just “political mischief”.

However, an AMANDALA article dated April 25, 2022 had reported, “Even long before an official complaint was made against Rene Montero, Sr., reports of his misuse of public equipment had already begun to circulate. In one instance, it was alleged that a number of Government-owned equipment, once believed to be missing or stolen, had been confiscated from one of Montero’s properties. And in another, a former associate of the ex-minister appeared on a Plus TV morning show with photos that purportedly were evidence of the use of government equipment on a private farm. At that time, both Montero and his son, Rene Montero, Jr. had maintained that all the allegations being made against him were false.”

The alleged offenses are believed to have occurred between April 14, 2016, and November 12, 2020, the day after the last general election.

Today, Police Commissioner Williams said that Montero may face justice shortly. At the time that Minister Julius Espat had first made the allegations against Montero, it was said that the criminal code sections under which the charges were being brought, actually applied to public servants and not elected officials. COMPOL Williams has indicated, however, that he disagrees with this interpretation.

“From my understanding of the law, the charges are appropriate, and we are going to see what happens in the court. It’s not a matter for me to decide the guilt or innocence of Mr. Montero, it is to happen for the court, and so the seasoned attorney, if he is going to be the one that will represent Mr. Montero, will have his day in court,” COMPOL Williams said.

Eroy the one to beat in Caymanas Park feature Loop Jamaica

USA-bred EROY and fellow American RUNAWAY ALGO square off in an epic clash at seven furlongs for Saturday’s Caymanas Park feature, the Eros Trophy, the ninth of 10 races scheduled.

Speedy RUNAWAY ALGO was caught close home by I’VE GOT MAGIC when hunting a fifth straight win on May 22. The quick three-year-old will try making all but faces a tough foe in experienced four-year-old, EROY, who won second-time out off a six-month lay-up, a fast-time victory at seven and a half furlongs in the Hubert Bartley Memorial on June 26.

Dale Murphy’s RUNAWAY ALGO has been burning up the exercise track, clocking 1:28.0 and 59.3 for seven and five furlongs, respectively, galloping out the mile chute.

Dick Cardenas, who was aboard Richard Azan’s EROY for his easy win, has opted for RUNAWAY ALGO, no doubt impressed by the three-year-old’s exercise form.

However, EROY won by 10 lengths with topweight 126lb, clocking 1:31.0, a second and two-fifths faster than I’VE GOT MAGIC’s win against RUNAWAY ALGO. EROY, who won in sloppy conditions, also returns seven pounds lighter, sitting level with RUNAWAY ALGO at 119lb.

EROY’s flashy performance was underlined by top-class MAHOGANY’s 1:30.2, six days later, on a good track, running nine pounds lighter at 117lb.

LIVERPOOL, England (AP) — An Everton fan who has been helping Ukrainian refugees was brought on to take a penalty during the Premier League team’s preseason match against Dynamo Kyiv.

Paul Stratton, a 44-year-old Liverpool municipal worker, has traveled to Poland to deliver supplies to refugees fleeing Russia’s invasion of Ukraine.

Stratton, in full Toffees uniform, came on as a substitute toward the end of Everton and Dynamo’s “match for peace” at Goodison Park on Friday night.

Everton manager Frank Lampard gave him instructions on the touchline before Stratton tucked away his penalty. Stratton then ran toward the stands to celebrate and was congratulated by Everton players.

The goal didn’t count and the game finished 3-0 in favour of Everton. The match was broadcast live nationally in Ukraine, the club said.

Proceeds will go to humanitarian charities supporting the people of Ukraine.

This was the first “match for peace” in Britain. Dynamo have played similar games in other European countries since the start of the war.

The crowd included 2,000 Ukrainian refugees who have been resettled in Merseyside communities. They were given free tickets.

REAL NEWS- Harold Lovell is decrying the aggressive position that Prime Minister Gaston Browne has taken in the matter involving the collapsed British American Insurance Company Limited (BAICO) and Colonial Life Insurance Company Limited (CLICO) and promises by the Government of Trinidad & Tobago to pay local policy-holders.

Browne is threatening to sue the T&T Government over its failure to pay the US$60 million balance on a US$100 million commitment.

The Prime Minister, in his usual fashion, made the announcement on his affiliated radio station – rather than on State media – on Saturday, July 23.

Lovell, the Political Leader of the United Progressive Party (UPP), says the Head of Government lacks diplomacy.

Lovell, an attorney-at-law, says the payment promised by the T&T Government was not an official court order; rather, it came about after months of negotiation. This is what is now needed, Lovell says: a meeting at the table.

The Political Leader says the Browne Administration may have an uphill battle litigating this matter.

BAICO and CLICO – a Trinidad-based conglomerate, went into insolvency in 2009, leaving Antigua and Barbuda policy-holders among those still owed millions of dollars.

The Government reportedly is pursuing litigation against the principals of the insurance companies.

Meanwhile, PM Browne said he hopes that Trinidad & Tobago is benefitting from the increase in fuel prices and therefore will put some system in place to cover the rest of its liability.
