Former AG Faris Al-Rawi. – Jeff K. Mayers

FORMER attorney general Faris Al-Rawi gave assurances that Vincent Nelson, KC, would not be prosecuted in the United Kingdom for crimes arising out of the alleged kickback conspiracy.

In a series of text messages with his former attorney Roger Kawalsingh, in October 2018, Nelson said he was concerned that the statement he gave, implicating former AG Anand Ramlogan, SC, and ex-UNC senator Gerald Ramdeen, was disclosed to the UK’s National Crime Agency (NCA), which is responsible for investigating serious and organised crime.

The NCA had written to Nelson on October 5, 2018, informing him they were in possession of a statement he provided to the TT Government. At the time, the NCA told Nelson he was the subject of a criminal investigation pursuant to the UK Bribery Act, which provided jurisdiction to prosecute a British citizen anywhere in the world.

Nelson’s concern was that the only persons in possession of that statement were himself and Al-Rawi.

Text messages between Al-Rawi and Kawalsingh revealed that the former had said the statement was provided to the UK authorities by Minister Stuart Young, whom Al-Rawi had said to police, was tasked with getting evidence against attorneys named in Nelson’s statement.

There were three series of text messages and in the third, Al-Rawi sought to reassure Kawalsingh, telling him Nelson was a whistleblower for the State and a beneficiary of an AG’s indemnity.

AL-RAWI’S

MESSAGE

On October 5, 2018, Al-Rawi wrote:

“Roger I can confirm that Mr Nelson QC as a whistleblower for the state (sic) is the beneficiary of the AG’s indemnity – the NCA is aware of the actual targets in the persons of Ramlogan and Ramdeen and the other English attorneys identified including …(names called) etc.

“The purpose of the NCA investigation is the (sic) secure the evidence on the other targets by confirming what has been provided already. We shall confirm Mr Nelson’s cooperation as a whistleblower, owner…our indemnity is obviously to be honored in full. It is key that the case is advanced with immediacy.”

The two then discussed payment of legal fees which Al-Rawi said was covered by the indemnity agreement.

On October 29, 2018, Al-Rawi said he met with the NCA in person to let them know TT’s only targets were “the lawyers Ramlogan and Ramdeen” and the UK lawyers named.

In that message, Al-Rawi tells Kawalsingh and got them to know Nelson was a whistleblower without whom TT could not succeed. He again gave assurances that they had the indemnity they could rely on.

Nelson was interviewed by the NCA on December 7, 2018, and was indefinitely suspended from the esteemed 39 Essex Street Chambers.

Nelson complained that his statement was disclosed to the Director of Public Prosecutions in January 2019, 13 months after Al-Rawi received it and only after taking a decision to make representations to the NCA to cede its investigations to the State of TT, pursuant to the Mutual Legal Assistance Treaty between this country and the UK.

At a meeting with Kawalsingh, the former AG showed him a letter from the NCA which acknowledged ceding the criminal investigation to TT.

AL-RAWI BLAMES YOUNG

There were also text messages Nelson sent to his attorney in 2017, which state he was willing to help in anyway he can, but it must not “result in any blow back against him in the UK.”

It also suggested he did not agree to give evidence at a trial of anyone named in his statement. Al-Rawi also allegedly told Nelson that his statement had been “wrongly disclosed” to the NCA by Young. Both Young and Nelson met on a British Airways flight from TT to London Gatwick in March 2020.

Nelson said Young came to his seat to converse.

After Young was told that it was Al-Rawi who said that Young had disclosed the statement, the latter replied that as a lawyer, “he wouldn’t be so stupid,” because he knew it would be a breach of the agreement.

Nelson said he was assured he would not be prosecuted. He said because of the wrongful disclosure to the NCA, he had to co-operate and face possible prosecution and jail in the UK, or be extradited to TT, both of which would destroy his professional career.

Nelson travelled to TT on April 29, 2019 to surrender to the Anti-Corruption Investigations Bureau (ACIB) and a plea bargain was reached with the DPP, not to recommend a prison term or have his assets confiscated if he gave evidence against Ramlogan and Ramdeen.

Immediately after pleading guilty, Nelson was permanently excluded from the Essex Street Chambers.

He was fined $2.25 million in March 2020 and one month later, was told he was under civil investigation in the UK for alleged underpayment of taxes. He is claiming £12.1 million from the TT Government for alleged breach of the indemnity agreement.

I MUST PROTECT ME

Nelson said because of his conviction, he cannot practise law and as a “black lawyer,” it would be inconceivable that any chambers in the UK would admit him as a member.

Before he entered his guilty plea, in May 2019, he said Al-Rawi accepted liability under the agreement and discussions were being had about an agreement for “repayment.”

Kawalsingh told Nelson he was expected to meet Al-Rawi on April 11, 2019 to draft the agreement. On April 12, Nelson said they (Kawalsingh and Al-Rawi) spoke and “we are looking at an out 2.6 to 2.8… He has to get advice from his attorneys before we firm it up.”

Nelson told Kawalsingh, with no written agreement and unless he got a clear undertaking to abide by the indemnity agreement and pay him for his lost years, he was willing to take his chances with the NCA and come “out of prison with enough under the indemnity to last me.”

“Apologies for being difficult but I need to protect myself.”

On May 20, 2019, he was told by his attorney “there is a commitment to pay. What we are trying to do is figure the best mechanism.”

Vincent Nelson

In his claim, Nelson is seeking £12,163,460 in damages for breach of indemnity because he can no longer work as a tax attorney in the UK. He is also claiming the State should indemnify him for the $2.25 million fine ordered by the High Court when he was sentenced in March 2020.

He also wants compensation for loss of insurance coverage because he was removed from Essex Chambers and for whatever claim the NCA may make for unpaid taxes associated with the fallout from the breach of the 2017 indemnity agreement.

In response to his claims, the State is now saying the agreement cannot be enforced as it runs contrary to public policy.

Recording made by dead mother claimed husband doused her with methylated, set her on fire

Dead Analee Gonsalves

…relatives hand over recording of woman’s version of events to Police

One day after 20-year-old Analee Gonsalves succumbed to her injuries while receiving medical attention at the West Demerara Regional Hospital (WDRH), her family released a recording of the woman debunking claims that she was burned with porridge by her 24-year-old husband.

It was previously reported that on August 23, 2022, Gonsalves was doused with hot porridge during an argument with her alleged abusive husband at their La Parfaite Harmonie, West Bank Demerara (WBD) home.

A relative of the dead woman told this publication that they were first told that the woman was burned on the face while cooking, but when they arrived at the hospital, they were told that she was burned with boiling porridge by her husband during an argument.

However, this publication was informed that after the incident, an investigation was launched but it was delayed because Gonsalves had refused to give detectives a statement.

This, the family said, was because the woman wanted to save her children – a one-month-old and an 18-month-old – before telling them the truth.

It was further reported that this was not the first time Gonsalves was abused by the man.Following the incident, the woman was admitted as a patient at the hospital with severe burns to her face, back, and other parts of her body.

Her husband, who was later identified as 24-year-old Ajay Persaud called “Nicholas”, had escaped and was on the run.

However, on Saturday the dead woman’s grandmother told this publication that after the rumour about her granddaughter being burned with hot porridge kept circulating, she along with family members released the recording of the woman’s statement to the Police and also on social media.

Analee Gonsalves while hospitalised

In the recording, the now-dead woman, who seemed to be in excruciating pain, said that the tale her husband is telling is not true.

In the recording she is heard saying, “On the 23rd of August, we [she and her husband] had an argument concerning a boxers. He did wan go on the road and the boxers he did wan, it didn’t dry, it did wet and he start cussing and throwing thing and suh in de room. Ah had nuff work fuh do, ah had to look after baby, ah had to mek dinner, ah had to drop meh netting and ah get angry and ah tek de cologne bottle and the cream and ah start throw dem through the window and while I throwing dem through de window… ah mek he bird cage fall down.”

The woman continued relating her story saying, “So when the bird cage fall down, he starting cussing up that if me know how much he bird worth and nothing in de room ain’t worth more than he bird. He look fuh he cutlass but he ain’t find it. And den he come back and open de methylated bottle, I went on de bed with me one-month-old baby, she deh lie down a lil part away from me and I de sit down…he open de methylated bottle… he start throwing it on me, and ah start stifle and ah turn over and lie down on meh belly and before ah turn round back, he spark he lighter… from behind…”.

She recalled that, “Meh baby went on the bed, ah didn’t want she get burn and the fire start ketching and he throw a sheet on me. And when he throw de sheet, the fire didn’t out and he pull me up but he couldn’t pull me up because de top that ah had on de already burn off.”

“Ah try pulling off meh pants and while ah pulling off meh pants he holler fuh Ashley, one ah he sister-in-law that went home, only she de went home with we, she did cooking. When he shout fuh Ashley, she run in de room and scramble the baby and then he guh and he shout fuh he mother from de veranda because she was at de street head not far from where we living. When he shout fuh he mother, she come in, when she come in now, she carry we at de hospital. When we reach at de hospital, she tell me that leh ah don’t talk de truth that Nicholas bun me, leh me seh that ah de boiling porridge and de stove blow up and de porridge bun me,” the woman is heard saying in the recording.

“When we deh at de hospital now, he (Persaud) get admit at Bess Hospital (for minor burns he received) and me get transfer to Georgetown (GPHC). The ambulance bring me (to GPHC) and lil after, he mother come. She did not inform my parents about anything, she tell de doctor dat she is my mother.”

“De next day (August 24), one of her friends come and visit me, a lady name Sabrina. When Sabrina come, he (Persaud) call on aunty Sabrina phone fuh talk to me and he tell me dat how if I talk de truth he gon kill he self and kill meh two children dem, that is why I never give de correct statement wah happen,” she explained.

The now dead woman claimed that after receiving the threat, she began thinking about her children and their safety. In the recording, she said she was praying to get better to save her children, but that never happened.

“Ah de waiting fuh go home and get meh children dem and then talk wah he do to me. But, after de pain start getting overbearing, ah give a statement. And now a feel like giving up because de pain getting more worse and worse. Somebody got to do something about he. Somebody got to do something about he.”

“…and a want meh children dem, when ah go home, ah want meh children dem. Ah want meh mother to get control ova ma children dem,” Gonsalves cried in the recording.

On remand: Ajay Persaud – husband of now dead Analee Gonsalves

Following the incident, an intelligence-led operation by the Police in Region Six resulted in the arrest of Persaud, who was later slapped with an attempted murder charge.

He remains in prison but is expected to make his next court appearance on October 20, when a murder charge will be instituted.

Meanwhile, the woman’s family said that they are hoping that the man faces the full brunt of the law and that justice for the death of the mother of two be served soon.

Pres Ali launches ‘1000 Men’ initiative to tackle societal issues

Black Immigrant Daily News

President Dr Irfaan Ali in Leguan Island

President Dr Irfaan Ali today announced the undertaking of a ‘1000 Men’ programme that seeks to tackle societal issues plaguing communities across the country.

This initiative, according to the Head of State, will be led by him and involve one thousand men from various aspects of society. These include the Joint Forces, the sport fraternity, the religious sector, the entertainment industry, the teaching profession, community workers and farmers as well.

The President explained that this ‘1000 Men’ program is established to reverse the strategy used to deal with problems facing young boys and men in society.

“The mission of this ‘1000 Men’ is to work in every single community to eradicate hunger, to work in every single community to lift up those who are emotionally [and] socially affected. It is to change every society and bring positive living and positive life in every single community. It is to work against violence, it is to work at making men better at being good men, responsible men, responsible boys, responsible youth in our society.”

Consequently, one thousand males in leadership positions will be deployed all across the country to work with and fully integrate every single man – both young and old – into the economic and social life of Guyana.

“Those who require training, we’re going to build a platform to give them training so that they can go and get the skilled jobs anywhere. There will be no excuse for men not to deliver on their responsibility and deliver on what is required of us to deliver to the people in our societies and to our families.”

The Head of State posited that his government, through this initiative, is on a mission to make a positive change in society. To this end, he noted that all assets and resources required will be deployed to ensure that all Guyanese in communities across the country are assisted with their hardships.

Residents of Leguan Island

This, he added, includes assisting those who are in need of help to deal with mental challenges, persons living with disabilities and so on.

However, the President contended that this will require males in society to play a more active role.

“We are working on a program to help every single community. It is refocusing the thinking of men themselves to understand that we have to be an active partner in making the changes we need in our society. We have to sit down and network. Men need to network across the country to understand that violence against women, violence against children is not accepted and will not be accepted and cannot be accepted in our society. But we can’t do this unless we network together.”

“You see, genetically and psychologically, men hardly share their emotional thoughts. But if we build a network in which you feel comfortable in speaking with persons within that network then it will help us.”

President Ali pointed out that this is an issue that is integral to a healthy society and if left unaddressed, then it will continue in the next generation.

“We need to stop every single aspect that brings negativity to the male population… That is why at the highest level in every aspect of our society, the Police Force will be deployed… because from within these organisations themselves, we have to create the change. We have to start creating the positive mindsets, the positive attributes.”

“I intend to reach far and deep in every community, in every entity, in every institution to bring those who are ready to contribute and to do what they should be doing for the upliftment of humanity in our country. And all who are ready to be on board, they’re doing it for… love for country. Understanding what love for country means; you can’t love your country if you hate those who are part of the country.”

At the time when President Ali was speaking about this program at the Leguan Masjid in the Region Three island today, he had some of the leaders who will be spearheading this initiative including the Chief of Staff of the Guyana Defence Force, Brigadier Godfrey Bess; Deputy Commissioner of Police – Operations (ag) Ravindradat Budhram; former West Indies cricketer Ramesh Sarwan; Cricketer Lennox Cush, and other religious leaders.

La gauche défile à Paris, Mélenchon…

Black Immigrant Daily News

The content originally appeared on: Guadeloupe FranceAntilles

Tax Office cannot find judge who has been living in St. Maarten for more than three years (UPDATED) – StMaartenNews.com – News Views Reviews & Interviews

PHILIPSBURG — A publication by the tax inspectorate in the National Gazette of September 30 has caused some confusion about the status of one of the judges that works at the Court in First Instance in Philipsburg.

The publication is a warrant from the Tax Inspectorate addressed to Cornelis Theodorus Mar Luijks, with the addition: “previously living at Madame Estate Road 2, Madama Estate, currently without known residence or whereabouts in St. Maarten or elsewhere.”

If this announcement were accurate it would pose a problem for the person in question, in this case Judge Coen Luijks, because the law stipulates that judges have to live in the place where they work.

But in this particular case, the Tax Inspectorate and Tax Bailiff Najesca Gumbs did not do their homework.

The Common Court of Justice in Curacao, when asked about the matter, confirmed that the person mentioned in the tax warrant is indeed Judge Luijks. Other than the Tax Inspectorate, the Common Court knows exactly where to find the judge.

On behalf of the court, Desi Dijkhuizen wrote to StMaartenNews.com that Luijks was appointed per August 1, 2019, as judge, stationed in St. Maarten.

“From August 1, 2019, Judge Luijks lives (again) in St. Maarten. Shortly afterwards he has registered as a resident at his current address with the Census Office. Since then he has been registered uninterruptedly at this address as a resident.”

UPDATE:

In the National Gazette of October 14, tax-bailiff Najesca Gumbs announces that the tax warrant addressed to Judge Luijks has been withdrawn.

Salah ends Man City’s unbeaten start as Liverpool triumph Loop Jamaica

Black Immigrant Daily News

The content originally appeared on: Jamaica News Loop News

LIVERPOOL, England (AP) — Mohamed Salah ended Manchester City’s unbeaten start to the season with his second-half goal securing a 1-0 win for Liverpool against the defending Premier League champion on Sunday.

On a dramatic day at Anfield, Liverpool manager Jurgen Klopp was sent off for furiously running out of his technical area, while City coach Pep Guardiola angrily remonstrated with the home fans after seeing Phil Foden’s goal ruled out by VAR.

Salah — who scored the fastest Champions League hat trick in history against Rangers on Wednesday — provided the decisive moment in the 76th minute after Alisson’s clever long clearance landed straight at his feet.

Racing clear, Salah swept a shot past Ederson to fire Liverpool ahead.

Just minutes earlier, the forward thought he was about to be substituted when his number was erroneously raised as Klopp prepared to make changes.

Defeat for City leaves Guardiola’s team four points behind leader Arsenal, which won 1-0 at Leeds earlier in the day.

Victory provides hope for Liverpool that they can recover from an unconvincing start to the season, which left then 13 points adrift of City before kickoff.

Despite Liverpool’s struggles so far this term, this still felt like a meeting of the Premier League’s elite after the two teams’ dominance in recent years.

That was underlined by an even first half, with both having chances to take the lead.

Andy Robertson fired Liverpool’s best chance over, while Erling Haaland forced two saves from Alisson and might have done better with at least one close range header.

The game burst into life after the interval when Salah raced through on goal and looked certain to score.

But the Egyptian’s effort went wide of the post, with replays later showing Ederson had provided a crucial touch.

That went unnoticed by the officials and City restarted the play with a goal kick, from which Foden eventually found the back of the net.

With the visiting fans rejoicing, VAR invited referee Anthony Taylor to review the incident on the pitch-side monitor.

Walking past a furious Guardiola, who remonstrated wildly, Taylor ruled the goal out for a foul on Fabinho in the buildup.

City’s manager was furious, repeatedly turning to the Anfield fans behind the dugout to gesticulate.

The crowd delighted in his anger and erupted shortly after when Salah fired Liverpool in front.

When Alisson collected an inaccurate free kick from Kevin de Bruyne, the goalkeeper then launched a kick downfield to perfectly pick out his teammate.

This time Salah made no mistake with his finish.

There was still time for more drama when Klopp raced out of his technical area to appeal a decision, leading to him receiving a red card.
