L’épineuse question des retraites a concentré les critiques des présidents de groupes parlementaires reçus mercredi à Matignon par Elisabeth Borne, conformément à sa volonté de “concertation” pour tenter de déminer une session qui s’annonce musclée.

La coalition de gauche Nupes faisait au même moment monter la pression sur le gouvernement, avec une proposition de loi pour taxer les “superprofits” des grandes entreprises et tenter d’obtenir un référendum d’initiative partagée, qui ne manquera pas d’animer les débats budgétaires. “Nous espérons que cette procédure va créer un rapport de force” avec la majorité présidentielle, a insisté le socialiste Olivier Faure.

“Concertation et écoute permettront de mener les réformes nécessaires pour le pays”, a plaidé de son côté, dans un tweet, la Première ministre qui, privée de majorité absolue à l’Assemblée nationale, prône le dialogue dans l’espoir de bâtir des “majorités de projet”.

Même si elle n’exclut pas, pour le vote du budget à l’automne, le recours à l’article 49.3 qui permet l’adoption d’un texte sans vote sauf motion de censure, car “les Français ne nous ont pas demandé l’immobilisme”.

Balayant le calendrier législatif, de l’assurance chômage au budget en passant par les énergies renouvelables, ses interlocuteurs ont cependant été nombreux à dire leur hostilité à l’idée que la réforme des retraites fasse l’objet d’un amendement au projet de loi de financement de la Sécurité sociale (PLFSS).

– “Contradictoire” –

Le président Emmanuel Macron avait évoqué cette éventualité lors d’une rencontre avec la presse, souhaitant une application “dès 2023”. Une décision qui “appartiendra” au gouvernement, avait-il ajouté.

Prudente, Mme Borne ne s’est toujours pas exprimée sur le sujet.

“Si c’est l’amendement, le gouvernement s’empalera”, a prédit le chef de file des sénateurs LR Bruno Retailleau, qui juge la réforme des retraites nécessaire, mais fustige une façon de faire “totalement contradictoire avec la fameuse nouvelle méthode [basée sur le compromis] proclamée par le président de la République”.

“On veut nous faire acheter un âne dans un sac, on ne sait pas comment la question retraite va être traitée”, a déploré le président du groupe communiste à l’Assemblée nationale, André Chassaigne, opposé à la réforme en soi.

Le chef de file des sénateurs écologistes, Guillaume Gontard, a jugé “inacceptable” de la faire passer dans un amendement.

L’hypothèse divise jusque dans la majorité.

Reçue en premier avec ses homologues du MoDem et d’Horizons, la cheffe de file des députés Renaissance, Aurore Bergé a plaidé “collégialement” en faveur d’une “décision rapide” sur les retraites.

Si le gouvernement devait recourir à l’article 49.3 de la Constitution, ce sera “la responsabilité des oppositions”, selon elle.

– “Pas tranché” –

Mais le président du groupe MoDem à l’Assemblée nationale, Jean-François Mattéi, a redit à la Première ministre l’opposition de ses députés à un tel amendement, même s’il approuve “la nécessité d’une réforme”.

“Nous avons été élus pour agir, non pas pour procrastiner”, a plaidé de son côté le président du groupe Horizons au Palais-Bourbon Laurent Marcangeli, qui sera “au rendez-vous de la réforme”, tandis que le sénateur macroniste François Patriat rappelait que le Sénat, à majorité de droite, amendait chaque année le budget avec une proposition sur les retraites.

Amendement ou pas, la question “n’est pas tranchée”, selon plusieurs participants.

Un amendement, “ce n’est pas un scandale” mais “je comprends aussi qu’il y ait le temps du dialogue et que ce n’est pas une décision évidente pour le gouvernement”, a temporisé le président du groupe Les Indépendants au Sénat, Claude Malhuret (Horizons).

En termes de méthode, le projet de loi sur les énergies renouvelables “sera un bon test” pour “voir si le gouvernement est en capacité justement de rebondir sur (les) propositions” d’EELV et parvient à “trouver d’autres majorités”, a dit espérer M. Gontard.

Son homologue à l’Assemblée nationale, Cyrielle Châtelain, a réclamé une “politique à la hauteur (du) bouleversement” climatique, et redit son “opposition complète” aux réformes “libérales” de l’assurance chômage et des retraites.

Mme Borne a de son côté souhaité, pour “construire des accords” avec les écologistes, “placer la planification écologique au cœur des politiques publiques, travailler ensemble pour atteindre le plein emploi et porter des perspectives communes”, selon un tweet.

Présence de sept skipers guadeloupéens

Les sept skipers guadeloupéens David Ducoson, Keni Piperol, Thibault Vauchel Camus, Willy Bissainte, Damien Seguin, Sacha Daunar, Rodolphe Sepho seront sur la ligne de départ à Saint-Malo.Rodolphe Sepho n’a malheureusement pas pu être présent pour cette conférence de presse.

Des parades avec les bateaux seront organisées les 25, 26, 28 et 29 octobre. Le village à Saint-Malo sera lui plus grand (70.000 mètres carrés) et accueillera du 25 octobre au 6 novembre, le public qui pourra admirer tous les bateaux réunis à l’intérieur des bassins.

Trinidad Artist Kalonji Gets Backlash Over IG Post After Girlfriend’s Death

Trinidad artist Kalonji Arthur has come under fire by some people for what they perceive as his insensitive remarks following the violent death of his girlfriend, 25-year-old Bridget James.

The 25-year-old artist of Delaford, Tobago, has seemingly recovered following the shooting incident and, according to a post he made on Instagram, is already focusing on new music. The message, which apparently came from his team, acknowledged the young woman’s death but also stated that he was already looking to get back into music. For many, it seemed that his period of mourning was too short.

“Grateful For all the continuous support, condolences & prayers also wanna send condolences on my behalf to Bri’s family and my sincerest apologies last but not least I wanna thank God for another opportunity @ Life and for keeping stable my mental status can’t wait to b back to being able to doing things I love especially my music @bri_xo1 love you always bbg. On behalf of me and the entire team @fully8recordz_ Thank you again.”

The shooting happened at the beginning of September as he and his girlfriend were celebrating her birthday. According to police reports, the couple was in the car park of the Brix hotel in Port-of-Spain Trinidad, sitting in a silver-grey Toyota Carolla at around 2:16 pm when another car approached.

Two gunmen exited and fired at them, hitting them both. They were rushed to the Port of Spain General Hospital, where Bridget sadly passed away.

The “Run Up” artist, who has over six million views for various songs on YouTube, was warded and said to be fighting for his life at the time.

One Twitter user expressed her displeasure with the message.

“The bullet that killed his gf was meant for him & his whole caption is giving ‘Welp.. Sorry it happened but glad it wasn’t me’,” she said, which brought in numerous comments from other Twitter users supporting her stance.

In a more recent post, Kalonji seemed to acknowledge the backlash. In a post that was made earlier today, September 21, he had a more simple and heartfelt caption that read, “Till my last breath b.”

Violence has continually plagued the Trinibad genre, and in the last two years, some artists have fallen victim to gun violence. In May, Trinidadian dancehall artist Fari Dan, who aligned himself with the Squash 6ix camp, was shot and killed.

That shooting happened in Tobago, and he was killed while at a bar on the island on May 15. In 2020, popular artist Kyle’ Rebel Sixx’ George was viciously gunned down inside his home at Viceroy Crescent, Bon Air Gardens, Arouca. He also claimed to be a member of the 6ix.

In one of the latest incidents of violence, unconfirmed reports indicate that the home of another popular Trinibad artist, Prince Swanny, was shot at.

It is believed that a car pulled up, and three men got out of it and shot at the house, some using automatic weapons. Initial reports stated that over 100 spent shells were recovered from the scene by police, but local media later reported that it was about 31.

The “Watch Your Friends” artist is currently in the US, where he continues to tour. He is currently focusing on dropping his upcoming album, Swanology, from his ZTEKK imprint.

OfReg investigation finds FLOW overcharged business customers Loop Cayman Islands

OfReg is investigating the pricing practices of telecommunications service provider FLOW.

It has, so far, confirmed that FLOW overcharged all of its fixed line business customers from January 2019 onwards by applying an unapproved rate increase from CI$30.00 to CI$35.00 per month.

Restrictions in FLOW’s operating licence at the time included the legal requirement to submit proposed rate increases to OfReg for review and approval.

To protect customers and promote competition in the marketplace, for any change in rate charges – increases or decreases – FLOW was required to provide evidence and justification to the regulator in advance.

At this point in the investigation, FLOW has admitted that it failed to comply with a licence condition to seek OfReg’s approval prior to applying the increased rate which has resulted in its business customers being overcharged by CI$4.99 per month.

OfReg has issued FLOW with an Administrative Fine Notice in relation to the contraventions, a process which affords Flow an opportunity to provide a formal response to the allegations.

After review of FLOW’s response the Office will issue a decision of its ultimate findings which will include any appropriate penalties.

OfReg will also consider other appropriate directives to be issued to FLOW.

The final determination and agreed course of action will be published by OfReg as soon as it is available.

Palo Seco man deemed flight risk, denied bail for 2021 murder

A 24-year-old Palo Seco man charged in 2021 for the murder of Erin villager Jeromy Rampersad has been denied bail.

In a recent ruling, Justice Lisa Ramsumair-Hinds refused the bail application of Ashmeer Persad Beharry after she held she was satisfied there were substantial grounds for believing he would fail to surrender to custody if released on bail.

In her 18-page ruling, after assessing the prosecution’s evidence and the seriousness of the offence, Ramsumair-Hinds said, “The risk of absconding is case-specific and in my assessment, it is high and cannot be mitigated/managed with conditions attached to the bail.

“I appreciate that he is relatively young and can be said to have an unblemished record. But that record, ‘white as the driven snow’ though it may be, is utterly bereft of any details that could positively weigh in the balance against the likelihood of flight.”

She said it was easy to see, on the strength of the proposed evidence, flight would be a tempting reprieve from the risk of a guilty verdict.

In her ruling, the judge said she objectively considered there was “an undoubted correlation” between the gravity of the offence of murder and a temptation to abscond.

“The more serious the offence, the longer the sentence is likely to be and therefore the greater the incentive to avoid attending court,” she said, noting also that unlike in other countries, murder has no categories of degree in Trinidad and Tobago.

“One cannot ignore the fact that murder is not categorised by degree and, with the exception of those cases where the felony-murder principle applies or where the accused person was under…18, the charge of murder is exceptional in that it attaches an automatic death penalty.”

Beharry was charged on May 7, 2021.

In a release, the police said Rampersad, 29, of Arena Village, was last seen at his home on April 23, 2021, and reported missing two days later. His burnt remains were found in Palo Seco on May 6.

In July, the Privy Council settled the law on bail applications for murder when it upheld the February landmark ruling of the Court of Appeal that section 5(1) of the Bail Act was unconstitutional. That section prevented judges from considering bail applications by anyone charged with murder.

The State was represented by senior prosecutor Anju Bhola, Beharry was represented by attorney Jeevan Rampersad.

HEALTH Minister Terrence Deyalsingh has said the weekly scheduled press conferences hosted by his ministry have come to an end.

In recent months the virtual press conferences were held at 11 am on Wednesdays and aired on TTT. Officials provided information about the spread of covid19 in the country and answered questions from the media and the public.

During the height of covid19 in TT, press conferences were held daily. This was then reduced to Mondays, Wednesdays and Saturdays.

Speaking at Wednesday’s press conference, Deyalsingh said it would be the last “of the series of press conference we’ve been having for the past two and a half years.

“Of course, if there are any developments that we need to come to you with, or that (are) concerning the public, we will hold a press conference at the Ministry of Health.”

He thanked the media, the public and healthcare workers.

“Today is a bit sad, but it’s a necessary thing because at the Ministry of Health, we want to move on to dealing with a lot of other issues, like our blood donation drive, our NCDs (non-communicable diseases), mental health and so on. So we need to reprioritise and refocus.”

Tobago gets 6 reports of damage caused by weather

The Tobago Emergency Management Agency (TEMA) has received six reports of problems on the island during the ongoing yellow-level adverse weather alert.

A weather alert issued on Tuesday by the MeteorologicalOffice warned of heavy showers and isolated thunderstorms expected over oceanic waters and extending across Trinidad and Tobago. This activity is associated with an active tropical wave with potential for development over the next few days. It said gusty winds of over 70km/hr can be expected.

Contacted on Wednesday morning, officials at TEMA said that they had received six reports of flash flooding, residential flooding and fallen trees in the road in Bacolet, All Fields Trace Carnbee, Mary’s Hill, Mt Grace, Mt St George and Roxborough.

On his Facebook page, THA Chief Secretary Farley Augustine warned the public to be careful.

Prison officer slashed by inmate to get compensation

A prison officer who was slashed on the chest with a broken razorblade by a prisoner will receive $70,000 for his physical and mental distress.

In a recent ruling, Justice Betsy Ann Lambert-Peterson ruled in favour of Sean George, who sued the State for negligence arising out of the June 28, 2015, incident at the Maximum Security Prison in Arouca.

In addition to the $70,000 in general damages, the judge also ordered the State to pay interest, as well as the cost of George’s psychologist’s fees and his legal costs.

George was represented by attorneys Jared Jagroo and Cheyenne Lugo. The State was represented by attorneys Savitri Maharaj, Monica Smith and Vandana Ramadhar.

In his lawsuit, George said he was on duty at the L Division of the MSP when a prisoner refused to comply with his instructions to leave a cell for a search.

As he trieed to remove the prisoner, there was a scuffle and two other prison officers had to assist. The inmate threatened to kill George with a pen.

While he was being treated for a cut to his chin, the inmate, who was also taken to the infirmary for treatment, lunged at him and slashed him in the chest with a broken razorblade.

Other officers eventually restrained the prisoner, but he still threatened to “deal with” George.

His witness statement said he heard the inmate say, “We will find you out dey, Mr George, and we will deal with you. Allyuh does be easy to find, Just know this ain’t finish yet and I not going to stop till you dead.”

George was cut on the chest and neck and was diagnosed with post-traumatic stress disorder.

At the trial, five prison officers testified for the State.

In her ruling, the judge said she took judicial notice of George’s injuries from the broken blade and also held the prisoner was not properly searched before being taken to the infirmary.

In its defence, the State maintained proper procedures were followed while the inmate was being escorted for treatment.
