35 antennes relais du réseau Orange sont actuellement indisponibles ainsi que plusieurs usines de productions d’eau.

La tempête Fiona a frappé la Guadeloupe dans la nuit de vendredi à samedi, occasionnant de très fortes précipitations. Le Sud de la Basse-Terre a été particulièrement touché par le phénomène. Les rivières ont débordé à Baillif, Basse-Terre et Vieux-Habitants et ont entraîné des évacuations et des mises à l’abri dans les équipements communaux pour une cinquantaine de personnes. La crue de la rivière des Pères a emporté une habitation à Basse-Terre et son occupant, ce dernier a été retrouvé décédé. 

Circulation très difficile

La commune de Capesterre-Belle-Eau a également connu des inondations et la circulation y est particulièrement difficile. A Goyave, le pont Saint-Pierre situé sur la RD 33 est désormais impraticable. En raison des inondations et des chutes d’arbres, la circulation est actuellement particulièrement difficile et risquée sur de nombreux axes de Guadeloupe. 

13000 usagers sans électricité

Les intempéries ont également entraîné des coupures sur le réseau électrique, 13 000 usagers sont actuellement privés d’électricité, notamment dans la zone de Trois-Rivière, Saint-Claude, Capesterre-Belle-Eau. 35 antennes relais du réseau Orange sont actuellement indisponibles ainsi que plusieurs usines de productions d’eau. Les interventions sont en cours pour rétablir les connexions. 

Le trafic aérien reste suspendu. 

Vigilance rouge en cours

En raison du maintien des conditions météorologiques défavorables, la vigilance fortes pluies et orages demeure au niveau rouge. Les vigilances vents violents et vagues – submersion restent au niveau orange. 

Les services de l’État et des collectivités restent mobilisés et effectuent des reconnaissances visant à l’évaluation des dégâts et au rétablissement des services. 

L’épisode est toujours en cours et il est toujours recommandé  par les autorités de ne pas se déplacer et de suivre l’évolution des conditions météorologiques.

Les services de Météo France ont confirmé que les effets de la tempête vont encore durer une grande partie de la journée et que la Grande-Terre va être impacter dans l’après-midi. Il y a eu de nombreux dégâts dans plusieurs communes suite aux inondations et aux éboulements. Quelques abris sûrs. Le point en ce milieu de journée !

Point météo

La Guadeloupe est encore en vigilance rouge. La tempête tropical Fiona est passée mais le caractère orageux et les pluies vont durer encore quelques heures. Elle poursuit son chemin vers l’ouest et l’oeil est déjà à 200 km des cotes de la Basse-Terre. Elle s’éloigne, baisse en intensité mais les effets induits perdurent. 

Routes de Guadeloupe

Sully Pandolf, directeur de Routes de Guadeloupe, demande aux habitants de ne pas sortir s’ils n’ont pas de motif impérieux pour permettre aux équipes mobilisées sur tout l’archipel de pouvoir dégager les routes. ” La RN1 vers Basse-Terre est circulable. On fait venir des entreprises pour dégager les axes principaux. On continue le travail de reconnaissance et de déblaiement. ” L’ensemble des équipes intervient.

Un décès à déplorer

Le préfet Alexandre Rochatte a confirmé la mort d’une personne à Basse-Terre. ”  C’était une personne dont on soupçonnait la disparition. Elle habitait une maison à Rivière des Pères emportée par les eaux. Malheureusement nous avons retrouvé son corps sans vie. “

” Un bilan humain déjà avec une personne décédée retrouvée peu avant 8 heures. Les services de secours ont été beaucoup sollicités, plus de 630 appels qui ont déclenché plus d’une centaine d’interventions et 23 personnes secourues. Il y a eu des inondations à Capesterre Belle-Eau, 9 Personnes à Basse-Terre et 10 personnes à Vieux-Habitants. Notez à Petit-Bourg, une personne coincée dans son véhicule a été prise en charge. “

Minimal reports of damage to properties

The National Office of Disaster (NODS) is reporting that there have several reports of minor damage throughout the island as a result of the effects of Tropical Storm Fiona.

District Disaster Coordinators (DDCs), who work within the various communities on behalf of NODS, have been conducting walk-throughs of their respective districts, after the local Met Office gave the all-clear and announced that the tropical storm warning was lifted.

According to the DDCs, there have been a few uprooted and downed trees, which brought down power lines, and the roof of a basketball stand in Freetown was blown off.

Acting Director of NODS Sherrod James said there was very limited use of the public shelters. About 20 individuals stayed in them throughout the night.

All the shelters that opened Friday afternoon in response to the storm’s threat have now beenclosed.

The National Emergency Operations Centre (NEOC), which consists of representatives from critical agencies who coordinate disaster management efforts at NODS whenever there is a threat, was partially activated.

This meant that only the police and defence forces, the fire department and a skeletal staff from NODS reported for duty.

James says critical agencies like the National Solid Waste Management Agency are doing their checks.

CoA upholds ruling that Maurice Arjoon was wrongfully sacked as NBS CEO

…but reduces his pension benefits from $59M to $18M

In a unanimous judgement, the Court of Appeal dismissed the appeal filed by the New Building Society (NBS), which was seeking to set aside a ruling by the High Court that the financial institution had wrongfully dismissed its Chief Executive Officer (CEO) Maurice Arjoon, in 2007.

An appeal to the Caribbean Court of Justice (CCJ) may, however, be likely as the NBS’s lawyer, Pauline Chase applied for and was granted a three-month stay of execution, as she wanted time to review the court’s judgement and seek further instructions from her client.

In July 2017, after a lengthy trial, Arjoon was awarded $79,282,801 in outstanding payments and benefits by High Court Judge Brassington Reynolds, some six years after he filed a $550M wrongful dismissal lawsuit against his former employer, arguing that he was wrongfully dismissed and that the institution had withheld pension and other benefits that were lawfully due to him.

After a successful levy on NBS’s assets to satisfy the judgement, Arjoon was able to clear a cheque for $59,033,281, representing pension payments.

This sum was part of the more than $79 million awarded by Justice Reynolds; the balance of $20,249,801 which was awarded to him as severance was, however, stayed by Justice of Appeal Rishi Persaud.

But Arjoon found himself defending his lawsuit at the appellate court after NBS moved to quash Justice Reynolds’s decision.

Background

Arjoon was fired from his position in connection with a Magistrate’s Court matter wherein he, and the mortgage lending institution’s former Operations and Assistant Mortgage Managers were accused of conspiracy to defraud the NBS of nearly $70 million. The matter was eventually dismissed, and Arjoon and the others took the financial institution to court in 2011.

The NBS had contended that an unauthorised withdrawal of nearly $70 million had been made from an account that its client Bibi Shamina Khan held. The NBS’s issue with the withdrawal was that it was made through a Power of Attorney, and the company had implicated Arjoon for misconduct.

An investigation had claimed that the fraud was committed in 2006, and the three men were all fired the next year after it had allegedly been determined that they were at fault for dereliction of duty, negligence, and/or serious/ gross misconduct.

However, Justice Reynolds in relying on case law, found that NBS did not provide substantial evidence to prove that Arjoon committed gross or serious misconduct which warranted his dismissal. As such, the Judge held that it was unfair for Arjoon to be dismissed when the bank had no systems in place to prove that he was guilty of any wrongdoing.

According to the Judge, during the trial, NBS admitted that it had poor systemic procedures of adequate checks and balances for detecting gross or serious misconduct such as the allegations levelled against Arjoon.

Appeal leg

Among the grounds of appeal advanced by NBS were that the over-riding defaults in Arjoon’s dealing with the withdrawals from Khan’s account were not taken into account by Justice Reynolds nor did he consider that the person making the withdrawals from the account was not duly and properly authorised to do so, thereby causing NBS a loss of over $79 million; and that his ruling was erroneous, in that, the pension could not be awarded together with severance and other benefits when an employee is terminated or dismissed.

In affirming the trial Judge’s decision, the Court of Appeal held that NBS failed to show that the transaction in question was directly related to the employment relationship.

While there were three transactions directly related to the employment relationship, none of them showed that Arjoon “by himself” was “directly responsible” for the incident, said acting Chancellor of the Judiciary Yonette Cummings-Edwards, who read the court’s ruling on Friday.

“In our view, this aspect of the evidence is not forthcoming. The NBS did not show that the behaviour of Arjoon in, itself caused that.” What the NBS has shown, Chancellor Cummings-Edwards pointed out, was that there is a line of authority and that there are a series of checks and balances prior to the transactions reaching Arjoon for his signature.

The appellate court agreed with Justice Reynolds’s finding that the necessary checks and procedures were adhered to through the transaction process by Arjoon. NBS had repaid the account holder the monies withdrawn. Even though it can be inferred that such actions can lead to a loss, a detrimentally economic one, the Chancellor said that NBS did not prove what effects it had on the business and more specifically that the transaction was related to Arjoon directly.

According to her, Arjoon alone did not deal with the transaction and there appear to be other clerks and other operatives who were collectedly involved in this one transaction.“As the trial Judge [Justice Reynolds] rightfully found in our view “there is no place for Peter to pay for all or Paul to pay for all in the circumstances”. It is not a case for ultimate responsibility but individual responsibility directly related to the employment relations. Thus, making a person a scapegoat for reasons of expediency…” Justice Cummings-Edwards noted.

Pension reduced significantly

The Court of Appeal, therefore, concluded that Arjoon discharged his functions by the regulations and systems in place and that the omissions, whatever they were, did not amount to serious misconduct. In the end, the appeal court only allowed NBS’s appeal on the issue of Arjoon’s pension entitlement and dismissed all of its other grounds of appeal.

As a result, his pension benefits were significantly reduced from $59,033,281 to $18, 817,432—which is subjected to any indebtedness to NBS. In computing the new sum, the Chancellor explained that the court considered the relevant provisions of the Termination of Employment and Severance Pay Act. The NBS was ordered to pay Arjoon $800,000 in court costs.

Arjoon was represented by Edward Luckhoo, SC. Apart from the Chancellor, Justice of Appeal Rishi Persaud and High Court Judge Franklin Holder, comprised the Bench.

Late Ombudsman Justice Winston Moore had found that Arjoon and the NBS’s former managers had suffered grave injustice as there was insufficient evidence to suggest that they were guilty, and more so to successfully prosecute them.

Govt targets interventions to enable longer lifespan, reduce threats from NDCs – Health Minister

Officials at the launch of Caribbean Wellness Week in Guyana on Friday

Guyana’s launch of Caribbean Wellness Week unfolded on Friday, under the theme: “Healthy Individuals, Communities and Organisations”, which focuses on actions to promote a healthy planet while addressing the threats of non-communicable diseases.

Health Minister, Dr Frank Anthony said during the launch at the Arthur Chung Conference Centre (ACCC), Liliendaal, Greater Georgetown that preventative measures can be taken to live longer and healthier lives.

According to him, targeted interventions can enable longer lifespans and curtail childhood illnesses.

“We want people to be constantly thinking about their health. It doesn’t matter what point in the life cycle you are in, you can take preventative measures so that you can live longer and healthier lives. We don’t want you to be sick before you come to the health system, but let us start very early.”

In Guyana, the life expectancy is almost 70 years but in developed countries, this number is higher.

A whopping 76.8 per cent of persons in the Caribbean die from non-communicable diseases – of which 30 per cent are cardiovascular diseases. A 2017 study showed that for every 100,000 persons in Guyana, 345 were dying from chronic NCDs. An estimated 60,000 persons are affected by diabetes – some of whom do not know their status.

“We have a lot of work to do to reduce the burden of non-communicable diseases,” he added.

The Minister pointed to inadequate sleep, stress, excessive alcohol, and smoking as other factors which need to change. Consumption of sugary beverages, fast food, and unhealthy snacks can lead to obesity. Excessive consumption of salt also creates risks, importantly hypertension.

He said it is a two-prong approach where sick persons take their treatment and healthy persons should do annual check-ups. For Guyana to be impacted positively by such awareness, the Health Minister opined that behavioural change is key.

Meanwhile, Prime Minister Mark Phillips stated that Governments must ensure the welfare of their citizens and access to safe healthcare. On his Administration’s end, he pointed to several projects in the pipeline to enhance public medical services – the six new regional hospitals, countrywide upgrades to primary healthcare facilities, and the multi-million-dollar partnership with Mount Sinai to establish specialised services.

The PM further shared, “Guyana has also introduced a robust telemedicine programme, which allows GPHC, New Amsterdam, and Bartica Hospitals to provide real-time consultations to patients remotely. A telemedicine pilot is also underway with four health centres in Region Nine.”

Director of Human Development at Caricom, Helen Royer also reflected that the current reality shows the region experiencing a mortality problem, brought on by NCDs, poor diets, and the increased use of alcohol and tobacco. She added that it is time to look at solutions that can turn around the figures and see improved results in communities.

Moreover, UN Resident Coordinator Yeşim Oruç reiterated that Sustainable Development Goals are linked to positive health outcomes and investments. Oruç relayed that stigma in mental health is one of the most important social challenges.

“Stigma in mental health conditions continues to be one of the most difficult public health and social challenges we grapple with. Although they are very common people living with mental health conditions often experience discrimination and are treated differently because of fear, misunderstanding, sometimes judgment.”

She added that UN agencies are working with the Ministry to integrate mental health concerns, and international health policies and support people to overcome these challenges.

“We hope that we can use today’s message of health in our neighbourhood to encourage individual and collective action that is supportive of people needing our support, that is, people struggling with mental health issues.”

Apart from the symposium and health fair, the Health Ministry also signed a charter to promote healthy living through organisations and agencies.

Incendian vehículo y embarcación en Humacao

La Policía investiga el incendio de un vehículo y una embarcación, a eso de las 12:12 de la madrugada del sábado, en la calle Fuego, de las parcelas del barrio Punta Santiago, en Humacao.

 Según el reporte preliminar, una persona utilizó un tipo de acelerante e incendió el vehículo Jeep Cherokee, año 2012, color negro y una embarcación de 20 pies de eslora, color negra y marrón, con dos motores.

El teniente Astacio, de la Estación de Bomberos de Humacao extinguió el mismo.

Los daños no fueron estimados.

Agentes adscritos a la División de Explosivos de Humacao, continúan con la investigación.

Centro Nacional de Huracanes emite aviso de huracán para PR

El Centro Nacional de Huracanes emitió un aviso de huracán para Puerto Rico tras publicar de las 11 de la mañana. 

Según los datos del avión cazahuracanes de la NOAA en el boletín de las 11:00 de la mañana del sábado, que el centro de Fiona se ha vuelto a formar más al este por lo que se emitió un aviso de huracán para Puerto Rico.

Se localizó el centro de la tormenta tropical Fiona cerca de latitud 16.3 grados Norte, longitud 63.5 grados Oeste. Fiona se está moviendo hacia el oeste cerca de 8 millas por hora (mph). Un movimiento hacia el oeste-noroeste a una velocidad de avance similar se espera que comience más tarde hoy, seguido de un giro hacia el noroeste el domingo por la noche.

Sobre el trayectoria pronosticada, se espera que el centro de Fiona se mueva cerca o al sur de las Islas Vírgenes esta noche, acérquese a Puerto Rico esta noche, y moverse cerca o sobre Puerto Rico el domingo por la noche. Fiona luego debería moverse cerca de la República Dominicana el lunes.

Los vientos máximos sostenidos están cerca de las 60 mph (95 km/h) con ráfagas más fuertes. Se pronostica fortalecimiento durante los próximos días, y Fiona se espera que se convierta en huracán el domingo o el domingo por la noche mientras pase cerca de Puerto Rico.

Los vientos con fuerza de tormenta tropical se extienden hacia afuera hasta 125 millas (205 km) desde el centro. Los datos del avión de reconocimiento indican que el mínimo la presión central es de 1004 mb (29,65 pulgadas).

Luma Energy reportó el sábado que más de 90,000 clientes están sin servicio de energía eléctrica.

Según el portal de Luma Energy, las regiones afectadas incluyen a Bayamón, Arecibo, Carolina, Caguas, Mayagüez, Ponce, y San Juan.

Según publicó en sus redes sociales, están trabajando en una interrupción de servicio ocurrida en varios sectores que afectó aproximadamente a 18,812 clientes por una falla en una subestación. También reportó que en Moca, personal de la compañía está atendiendo una interrupción de servicio que afecta a más de 10,000 abonados.
