As the Minister who hosted the National Consultation on the draft amendments to two electoral laws – the Representation of the People Act (ROPA) and the National Registration Act (NRA), I shall begin by repeating what l said in my seven-minute opening on October 25th although the APNU+AFC representatives were present:

Firstly, on October 29, 2021, the President announced that the draft amendments to the electoral laws would be made publicly available on social media within one week of the announcement. On November 5, 2021, the amendments to the ROPA and draft regulations to the ROPA were posted on the Ministry of Parliamentary Affairs and Governance’s Facebook page. The public was invited to submit comments, observations, and changes first within six weeks, which then stretched to almost one year.

To the credit of the then General Secretary and Chairperson of the PNC, Ms. Amna Ally and Ms. Volda Lawrence, both asked the Ministry for hard copies of the draft amendments, which were promptly provided to them.

On May 9th and 19th, 2022, the Attorney General met with the respondents to the draft amendments to the ROPA. Neither the APNU+AFC Coalition, the PNC nor the AFC submitted any comments or changes to these drafts prior to or after the May meetings. On September 29th, 2022, the draft amendments to the National Registration Act were also publicly posted on the Ministry’s Facebook page.

These parties were invited to the National Consultation on October 25th and predictably walked out alleging that Minister Nandlall and l had taken two hours out of a three-hour consultation. The AFC forgets that in this electronic age, records of time are captured; first of all, I spoke for seven minutes in my opening; the Attorney General was asked to do an overview of the draft laws and rationale behind the amendments, he spoke for 1 hour and 15 minutes. After this he began the examination of the draft amendments to the acts. We then took a break at 2:50 pm and concluded after 5:00 p.m. The APNU/AFC representatives, Mr. Khemraj Ramjattan, Mr. Roysdale Forde and Ms. Tabitha Sarabo-Halley walked out only one hour after the consultation began.

For the AFC to assume what were the reasons for Mr. Jonas’ and Mr. Mahadeo’s departure is rather presumptuous particularly as the latter publicly stated why he was leaving, and it was not for the same reasons as the AFC representatives.

More importantly, how does the electorate treat with any political party and its elected Members of Parliament who are so dismissive and uninterested in amendments of these statutes after the punishment and stress that the nation and the citizenry went through during the five-month delay following the March 2nd 2020 Elections? Is this not the height of political irresponsibility?

These very statutes define and protect the electoral process in our country, and guard our fundamental right to elect our representatives to government periodically as enshrined in the constitution. These amendments emerged to ensure that there would no “Mingo-ism” in future elections.

The Ministry of Parliamentary Affairs and Governance is pleased to have hosted this consultation which included representatives of faith-based organisations, political parties, private sector, and other civil society organizations and actors. Contrary to response by the AFC, the feedback received from the consultation participants was especially positive as they noted to have found the session informative and enlightening, and they appreciated being invited and included in the ongoing electoral reform process.

Home Affairs Minister Robeson Benn has announced that he is contemplating the possibility of government contracting private firms to tow vehicles that illegally park in the city.

“I have been thinking recently of outsourcing the towing services to private people so that the double-parking, the blocking of vehicles on the roadways that lead to a lot of congestion – if we outsource that activity – it would go a long way along with the backup of the Police Force in making our city, our roadways safer, less congested…,” Benn revealed.

He made the announcement on Monday evening at the launch of the Road Safety Council’s Magazine and Website.The magazine is in collaboration with the Ministry of Home Affairs and the Guyana Police Force. The collective effort is to strategically and effectively improve public awareness of road safety.

According to the Home Affairs Minister, speeding and inattentiveness continue to be among the leading causes of accidents on the roadways.

“From statistics of the Guyana Police Force, we see that speeding is a critical issue on our roadway, inattentiveness and driving under the influence,” he expressing, noting that traffic officers need to make an extra effort to curb these issues during the holiday season.

Moreover, Minister Benn said he wants to see an increase in the usage of the ticketing system for traffic offences.“The amount of tickets which the police have given out has fallen behind what was given out last year and I think that is one thing which we have to pay attention to,” Minister Benn posited.

“Give people tickets on the road and not tell them to go to the station where there is a lot of wastage of time,” he encouraged traffic officers.

The opposition United Workers Party (UWP) held its promised ‘People’s Protest’ in Castries on Tuesday morning, with leader Allen Chastanet promising similar events islandwide.

Participants in the activity chanted slogans, including that Chastanet would return to save Saint Lucia.

And they referred to the bazooka man having to go.

It was an apparent reference to the House of Assembly Speaker, Claudius Francis, whose recent comments on his television show about using a bazooka prompted opposition calls for his resignation.

“This is a series building up and getting people to come out and speak their minds,” UWP leader Allen Chastanet said regarding Tuesday’s protest.

“We are going to do that throughout the length and breadth of this country and mobilise people on the ground that the people’s parliament has to be activated,” he declared.

“Even if one person came out – it’s a beginning,” the former Prime Minister declared.

According to Chastanet, the Saint Lucia Labour Party (SLP) government must recognise that while it can get away with a majority in the parliament, they do not have a majority in the ‘people’s house’.

However, the Micoud South MP asserted that for that to work, people must show up, be counted, and make their voices heard.

Chastanet said he was pleased with Tuesday’s turnout at the protest, which started at Derek Walcott Square.

UWP supporters later made rounds on the William Peter Boulevard.

“We were restricted in the numbers we could have but that’s fine. I know that the police had a very long weekend with Jounen Kweyol,” he explained.

Chastanet said the protest targetted the Speaker of the House.

Chastanet said the Speaker had made a fiasco of the House Privileges Committee matter intended to discipline him.

“We wrote him a letter outlining all the procedural problems that he had but he chose not to listen to the letter,” Chastanet noted.

“Instead he waited until the beginning of the case at nine thirty for his lawyers to come and say ‘Look, we have advised the Speaker that he is all wrong and he has agreed to withdraw’,” the UWP leader stated.

“We need to stand up. We have had several victories,” Chastanet declared, adding that he would soon announce retractions he has requested regarding false statements by administration officials.

“Every time that this government steps out of line I can say I am one who is going to stand up and I am really hoping today that there are hundreds of people here who agree on that movement and that number will turn into thousands,” the former Prime Minister stated.

Migos Rapper Takeoff Shot Dead At 28 In Houston, Quavo Not Hurt

In a shocking turn of event for the Migos rap group, Takeoff, one-third of the Atlanta group, has died. Multiple sources confirmed with Urban Islandz that he was shot dead in an early morning shooting in Houston and passed away from his injuries at age 28.

The shooting took place at a bowling alley called 810 Billiards and Bowling Houston and happened around 2:30 AM. That’s when several witnesses began calling the police to say that a man had been shot at the bowling alley.

Takeoff, whose real name is Kirshnik Khari Ball, was the youngest member of Migos. He formed a part of the power trio that included Quavo, who is his uncle, and Offset.

According to reports from TMZ, Takeoff and Quavo were there playing dice when some sort of argument broke out. Following that, someone is believed to have opened fire, shooting Takeoff. The shot is believed to have either hit him in the head or near his head. He died at the scene.

Footage from the scene shows Quavo in an orange shirt and others gathered around Takeoff. They tried to move the “Walk It, Talk It” rapper but gave up on the attempt. Quavo can then be heard urgently calling for help. He was not hurt in the shooting.

Authorities have disclosed that two other people were shot and have been taken to the hospital. Their condition hasn’t been confirmed as yet. It would seem that Quavo was having a night out on the town as just a few hours before the shooting, he posted a video driving around Houston with Jas Prince, who was celebrating his birthday.

It also looks like Takeoff was part of the party, as he also posted a selfie a few hours earlier from the bowling alley.

The group started their journey in 2008 in Georgia and would go on to become multi-platinum hitmakers. Their first major hit was “Versace” in 2013. They would ride the success of that hit and would record a number-one hit on Billboard in 2016 with “Bad and Boujee.”

Earlier this month, while speaking on the Big Facts podcast ahead of their album release, Quavo shared his thoughts and confirmed that the Migos were no longer together.

“I just feel like we want to see our career as a duo, you know what I’m saying, because, you know, we just came from a loyal family. We are supposed to stick together,” he said at the time.

Our condolences go out to the family at this difficult time as the hip-hop community tries to come to terms with yet another violent gun death of a young rapper.

Quavo was not hurt in the shooting incident.

Les barrages routiers se sont multipliés mardi matin au Brésil au surlendemain de l’élection de Lula à la présidence, des centaines de camionneurs et de manifestants pro-Bolsonaro refusant d’accepter la défaite du président d’extrême droite.  

Jair Bolsonaro restait muré dans son silence depuis l’annonce dimanche soir de sa défaite de peu (49,1% contre 50,9% face à Lula), et n’avait toujours pas reconnu la victoire de son ennemi juré.

Lancé la veille, le mouvement de protestation sur les axes routiers a fait tâche d’huile mardi. La police routière fédérale (PRF) faisait état de 250 barrages, totaux ou partiels, dans au moins 22 des 27 Etats du Brésil. Lundi soir, seulement une douzaine d’Etat étaient concernés. 

“Lula non!” était-il inscrit sur un panneau accroché au-dessus d’un viaduc à Sao Paulo, la capitale économique, où plusieurs routes étaient également bloquées, notamment celle qui relie la mégalopole à Rio de Janeiro, empêchant le départ des autocars entre les deux villes.

À Novo Hamburgo, près de Porto Alegre (sud), la police a fait usage de gaz lacrymogène pour disperser les manifestants. 

Santa Catarina (Sud), où Jair Bolsonaro a remporté près de 70% des voix, est l’Etat qui comptait le plus de routes bloquées. 

“J’espère rentrer chez moi” à Rio. “J’ai pu payer une nuit dans un hôtel ici mais beaucoup de gens ont dû dormir ici à la gare routière”, a déclaré à l’AFP Rosangela Senna, agent immobilier de 62 ans, à Sao Paulo.

Un juge de la Cour suprême a ordonné le “déblocage immédiat des routes et des voies publiques”, a indiqué l’institution dans un communiqué lundi soir. 

Il a ordonné à la PRF de prendre “toutes les mesures nécessaires” pour dégager les routes, sous peine d’infliger une amende à son directeur général ou de l’emprisonner pour “désobéissance”. 

Appels à manifester

Plus de 36 heures après les résultats officiels, le président sortant Jair Bolsonaro n’a toujours pas reconnu sa défaite sur le fil, contrairement à plusieurs alliés de son gouvernement ou du Parlement.

De très nombreux chefs d’Etat étrangers ont félicité depuis dimanche soir Luiz Inacio Lula da Silva, le candidat de gauche, pour son troisième mandat à la tête du pays, après ceux de 2003 à 2010. 

Il prendra officiellement ses fonctions au 1er janvier, mais dès maintenant une transition du pouvoir devrait avoir lieu — si le gouvernement sortant accepte de coopérer. 

Brasilia était calme mardi matin après que la police a restreint depuis la veille au soir l’accès des véhicules à la place des Trois pouvoirs, où se trouvent le Palais présidentiel, le Parlement et la Cour Suprême, proche de l’immense esplanade des ministères, lieu traditionnel de rassemblement dans la capitale. 

Cette mesure “préventive” a été prise “après l’annonce d’une possible manifestation à cet endroit, sur les réseaux sociaux”, avait indiqué le secrétariat de la Sécurité publique du district fédéral de Brasilia .

Les appels de bolsonaristes à rejoindre les barrages se multipliaient en effet sur les réseaux sociaux, notamment Twitter et Telegram, selon l’équipe de vérification numérique de l’AFP.

L’un d’entre eux appelait les bolsonaristes à un grand rassemblement à 15H00 (18H00 GMT) sur l’immense esplanade des ministères de Brasilia.

“Le Brésil ne sera pas le Venezuela”, disait le message sur fond jaune et vert, comme le drapeau national, affectionné par la droite radicale. Il reproduisait le texte adressé à son père par le sénateur Flavio Bolsonaro lundi: “Bolsonaro, nous sommes avec toi quoiqu’il arrive”.

A Sao Paulo, des bolsonaristes misant sur une poursuite du mouvement appelaient pour mercredi après-midi à “la plus grande mobilisation de l’Histoire” sur l’Avenue Paulista — cette même avenue inondée dimanche soir par une marée de centaines de milliers de sympatisans de Lula vêtus de rouge, qui avaient célébré dans la liesse la victoire de leur champion.

A Sao Paulo, les axes routiers menant à l’aéroport international de Garulhos, qui a le plus gros trafic aérien du Brésil, ont été dégagés par la police en matinée, après des annulations ou retards de plusieurs vols, a rapporté la presse locale.

La police militaire était par ailleurs en fin de matinée en train de dégager certains axes routiers de Sao Paulo, Rio de Janeiro et du Minas Gerais, sur l’ordre des gouverneurs de ces Etats très peuplés du sud-est.

WORC and Immigration Appeals Tribunal facing another court challenge Loop Cayman Islands

A notice of a motion was filed in Court on August 12, 2022 requesting that the decisions of the director of Workforce Opportunities & Residency Cayman (WORC) and the Immigration Appeals Tribunal (IAT) be set aside as they relate to the refusal of the grant of Permission to Continue Work made by a man working in the construction industry.

The reasons for the request to set aside the decisions are that, allegedly, they were erroneous, unlawful, in breach of natural justice and at variance with the regulations, and in clear contravention of Sections 24(8) and 66 of the Immigration (Transition) law 2022.

The motion also says that the aforementioned decisions have placed the man’s employers in a predicament, being that the man heads up the works in relation to a school building contract and completion of work on the Court Building, situated in the old Scotia Bank Building. More specifically, the motion says that the “projects are now nearing completion and are therefore fraught with “breach of contract” implications” for the man and his employers.

In addition to setting aside the decisions of the director of WORC and the IAT, the man is seeking a declaration that the director of WORC and the IAT be “restrained and prohibited from any and all actions the objective of which is the detention of the Applicant, and or removal from the Cayman Islands, under any provision of the Border Control Law or the Immigration (Transition) Law (2022 Revision) until an Appeal is determined.”

The motion adds to a mounting number of challenges submitted in recent times in relation to the validity of the decisions of the immigration authorities in the Cayman Islands.

CHARLESTOWN, NEVIS, November 01, 2022 (NIA) — Hon. Troy Liburd, Jr. Minister of Education in the Nevis Island Administration (NIA), welcomed a delegation of 18 faculty members of the University of the Virgin Islands (UVI) to his office on October 27, 2022, to hold discussions in an effort to strengthen the partnership between the entities.

During brief remarks, Mr. Liburd expressed satisfaction with the importance the university placed on their relationship with Nevis and its people.

“I am indeed delighted this morning that so many of you have come…I didn’t expect so many people. That makes me feel good. It shows that Nevis is important to the University of the Virgin Islands so you have brought so many people, and I’m sure that we would have a very robust and good discussion and I’m hopeful that at the end of the discussion that we would have something in the best interest of the University of the Virgin Islands and of course the people of Nevis, the young people of Nevis who are seeking to further their education.

“We are hopeful that whatever comes out of our discussion that it would sway more young people to choose the University of the Virgin Islands because it would be such a good deal that Nevisian students would not be able to resist it. So I’m very, very happy that all of you have come,” he said.

Dr. Kendra Harris, Dean of the School of Business at the UVI, gave the Department of Information some insight into the visit.

“We are here today, this past three days in St. Kitts and Nevis meeting with a number of dear close constituents in the country, ensuring that we can further our partnership through our memorandum of understanding that we have with both the government and the college here,” she said.

Mr. Mitchell Neaves, Vice President for Instructional Advancement at the UVI, added that their visit to Nevis was specific to the needs on the island.

“We brought with us a delegation of 18 individuals to strengthen and leverage the relationship we have with the stakeholders here on Nevis and to ensure we are being good partners in determining what the needs are and how we can operate to continue to facilitate mutually satisfying relationships between Nevis and the University of the Virgin Islands,” he explained.

Also present were Mr. Kevin Barrett, Permanent Secretary in the Ministry of Education, who chaired the brief welcome ceremony; and Ms. Zahnela Claxton, Principal Education Officer in the Department of Education.

Le Premier ministre indien Narendra Modi s’est rendu mardi dans la ville où plus de 130 de ses concitoyens ont trouvé la mort dans l’effondrement d’un pont piétonnier récemment rénové.

Sous les yeux du Premier ministre venu se recueillir, des sauveteurs à bord de bateaux pneumatiques continuaient de manoeuvrer et de draguer le lit de la rivière, les opérations de recherches se poursuivant, deux jours après la catastrophe de Morbi, située à 200 kilomètres à l’ouest d’Ahmedabad, principale ville de l’Etat du Gujarat dont est originaire M. Modi.

La mort de 134 personnes dans l’effondrement du pont, dont 47 enfants, a été confirmée, a déclaré mardi matin à l’AFP Rahul Tripathi, commissaire de police à Morbi. 

Un précédent bilan, qui donnait 137 morts à la suite d’une confusion lundi, a été revu à la baisse. 

“Nous n’avons pas encore mis fin aux opérations de recherches, car nous craignons qu’il reste des victimes dont les proches ne savent pas où elles se trouvent et ne nous ont pas encore contactés”, a-t-il expliqué.

Les autorités ont évalué à 500 le nombre des personnes qui célébraient les fêtes de Diwali sur ce pont, datant de l’époque coloniale, quand les câbles qui le soutenaient ont subitement lâché. 

Le pont venait de rouvrir au public après plusieurs mois de travaux de rénovation. 

Autorités “nulles”

Dimanche soir, selon des images de télésurveillance, la structure s’est balancée avant de céder, précipitant une partie de la foule dans la rivière.

Ilyas Khan Akbar Khan Pathan, un chauffeur de rickshaw de 33 ans, a perdu dans l’accident sa femme, ses deux enfants, âgés de six et trois ans, sa belle-sœur et ses deux nièces. 

“Nous avons trouvé les corps vers quatre heures du matin. Ma fille Mahiya avait la tête dans la boue, des gens sont allés la chercher en bateau”, a déclaré M. Pathan à l’AFP mardi. 

“La police et l’administration ont mis près de deux heures à lancer l’opération de sauvetage (…) Les autorités ont été nulles”, a-t-il déploré.

Le président chinois Xi Jinping a adressé à son tour ses “profondes condoléances”, mardi aux familles des victimes dans un message adressé à la présidente Droupadi Murmu et au Premier ministre Modi.

D’autres arrestations suivront

Les rénovations du pont auraient été effectuées par le groupe local Oreva, dont l’expertise porte notamment sur les horloges et les vélos électriques. 

Mercredi dernier, jour de la réouverture du pont au public, Jaysukh Patel, président d’Ajanta Manufacturing, une entreprise du groupe, avait déclaré que le pont pourrait aisément tenir encore une quinzaine d’années.

Sandeepsinh Jhala, à la tête de la municipalité de Morbi, a indiqué lundi qu’aucun certificat de conformité n’avait été délivré avant sa réouverture au public.

Lundi soir, la police a annoncé l’arrestation de neuf personnes, inculpées d’homicides involontaires, dont deux directeurs d’Oreva, deux sous-traitants et également deux vendeurs de billets d’accès au pont, accusés d’en avoir trop vendu et d’avoir ainsi provoqué la surcharge du pont. 

Trois agents de sécurité ont également été arrêtés “car ils n’ont pas réussi à gérer la foule sur le pont”, a précisé lundi soir à la presse un haut responsable de la police, Ashok Yadav. 

“Au fur et à mesure que l’enquête progresse, les noms d’autres personnes associées au groupe Oreva seront également arrêtées”, a déclaré M. Yadav. 

Il a ajouté qu’une équipe d’enquête spéciale (SIT) a été formée pour enquêter sur les aspects de la maintenance et de la sécurité structurelle du pont.

Au crématorium de Morbi lundi, Puneet Pitroda, un négociant de textiles de 35 ans, pleurait la mort de son frère et sa belle-sœur.

“Les autorités sont entièrement responsables de cette tragédie”, a-t-il déclaré à l’AFP, “elles ont permis à des centaines de personnes de se rassembler sur ce pont qui ne pouvait en accueillir qu’un nombre limité”. 

Et d’ajouter : “nous n’oublierons jamais cette nuit”.

La mairie de Tokyo a commencé mardi à remettre des certificats d’union aux personnes de même sexe qui vivent ou travaillent dans la capitale japonaise, une mesure attendue depuis longtemps dans un pays où le mariage gay n’existe pas.

Le Japon est en effet le seul pays du G7 à ne pas reconnaître les unions de même sexe, sa Constitution disposant que “le mariage ne peut avoir lieu qu’avec le consentement mutuel des deux sexes”.

Les certificats de la ville de Tokyo permettent aux partenaires LGBTQ d’être traités comme des couples mariés pour certains services publics liés au logement, à la santé ou à la protection sociale.

La mairie d’arrondissement de Shibuya, quartier branché de Tokyo, a été la première au Japon à proposer un tel certificat, en 2015. Plus de 200 municipalités ou autorités locales ont suivi depuis.

Ces certificats sont loin de conférer les mêmes droits qu’un mariage légal, mais le nouveau statut proposé par la mairie de Tokyo représente néanmoins un progrès pour Miki et Katie, deux femmes qui pendant longtemps n’ont disposé d’aucune attestation officielle de leur vie commune.

“Ma plus grande crainte était que nous soyons traitées comme si nous étions étrangères l’une à l’autre en cas d’urgence”, confie à l’AFP Miki, une Japonaise de 36 ans, aux côtés de sa petite amie américaine Katie, 31 ans. Elles ont préféré n’être identifiées que par leurs prénoms.

Faute de certificat, chacune avait l’habitude de glisser une note dans son portefeuille avec les coordonnées de l’autre, au cas où. “Mais il nous semblait que des documents officiels validés par les autorités locales seraient plus efficaces”, explique Miki.

“Grand pas en avant”

En date du 28 octobre, 137 couples avaient déjà demandé un certificat d’union, a déclaré la semaine dernière Yuriko Koike, la gouverneure de Tokyo.

Les espoirs sont grands que la délivrance de tels certificats, qui s’appliquent à la fois aux résidents de Tokyo et aux personnes vivant en banlieue mais travaillant dans la capitale, aidera à lutter contre la discrimination anti-LGBTQ au Japon.

Grâce à ce nouveau système à Tokyo, “j’espère sincèrement que nous pourrons accélérer les efforts pour créer une société où les droits des minorités sexuelles pourront être protégés et rendus plus égaux”, a déclaré la militante LGBTQ Soyoka Yamamoto lors d’une conférence de presse.

Elle et sa partenaire Yoriko vivent ensemble depuis plus de dix ans. Elles ont reçu leur certificat d’union de la mairie de Tokyo mardi matin.

“J’espère que nous pourrons désormais accéder à divers endroits et services, sans avoir à expliquer notre relation”, a déclaré Yoriko en qualifiant la décision de Tokyo de “grand pas en avant”.

Un sondage réalisé en 2021 par la télévision publique NHK a montré que 57% des personnes interrogées étaient favorables au mariage homosexuel.

Cependant le Parti libéral-démocrate au pouvoir (PLD, droite conservatrice) se montre très frileux quant à une éventuelle réforme législative en ce sens.

Et les débats juridiques sur le sujet semblent partis pour durer. En juin dernier, un tribunal d’Osaka (Ouest) a débouté trois couples de même sexe qui avaient porté plainte contre l’Etat, jugeant que la non-reconnaissance du mariage gay n’était pas contraire à la Constitution.

A l’inverse en 2021, un tribunal de Sapporo (Nord) avait, lui, estimé que la situation actuelle violait le droit à l’égalité garanti par la Constitution.
