Basseterre, St. Kitts, October 28, 2022 (SKNIS): The Civil Aviation (Amendment) Bill, 2022, which was debated in the Federal Parliament on October 27, was successfully passed paving the way for enhanced safety and security of the aviation sector for the Organization of the Eastern Caribbean States (OECS) region and its Member States.

Mover of the Bill and Minister with responsibility for Civil Aviation in the Federal Government, the Honourable Marsha Henderson said that the “purpose of the proposed amendments before the honourable House today, is really to address and rectify the issue regarding the demotion of the Eastern Caribbean Civil Aviation Authority (ECCA) from Category One to Category Two status by the United States of America Federal Aviation Administration (FAA).”

Minister Henderson underscored the importance of the aviation sector adding that the Government of St. Kitts and Nevis understands its usefulness.

“Madam Speaker, our Government fully understands and appreciates the importance of the aviation industry. The amendments take a balanced approach between the need to protect the traveling public and, of course, ensuring the viability of the sector,” said Minister Henderson. “These amendments, Madam Speaker, are really about general aviation and balancing the critically important need for safety with making sure that the regulating burden is not too great to bear.”

The honourable Minister noted that the Government will continue to play its part to ensure the Federation is on par with the OECS and other relevant partners.

“We as a Government will continue to monitor the implementation and work with the Organization of the Eastern Caribbean States and the sector to bring forward additional reforms if they are required. We understand, Madam Speaker, that the main objective of the Civil Aviation Act is to enhance and promote safety within the aviation sector,” said Minister Henderson. “So it is absolutely important for us to ensure that the focus is always maintained even with amendments.”

Minister Henderson, who is also responsible for tourism, said that “aviation is a critical part of our everyday lives and has become a critical component of the air transport sector.”

“A vibrant aviation sector is important for many industries including the tourism industry. I think it is important Madam Speaker, for us to understand that the aviation industry is something that we rely heavily on as a tourism destination, and as such Madam Speaker, it is important that we maintain not only as a country but as a region… the status of a country that does comply with the standards of the International Civil Aviation Organization.

The Civil Aviation [Amendment] Bill, 2022, was largely supported by members on both sides of the aisle.

December 12 is Nomination Day for LGE polls

The Guyana Elections Commission (GECOM) has designated December 12, 2022, as Nomination Day for the upcoming Local Government Elections (LGE), which are set to be held next year March.

GECOM announced the Nomination Day date in a notice that also called for parties to submit their symbols. On Nomination Day, parties make their way to a designated location, where their representatives are usually required to submit their List of Candidates to the Chief Election Officer, as well as sign on to the required documents, such as a code of conduct, to contest the elections.

These representatives are usually accompanied by a large retinue of their supporters, dressed in party colours, although all the parties who submit symbols do not always make a grand entrance or even come at all.

According to the notice, contesting parties, voluntary groups and individuals must submit their symbols by November 12, 2022, in accordance with section 48 (1) of the Local Authorities (Elections) Act, Cap 28:03. The law requires that these symbols be submitted at least 21 days before Nomination Day.

“Political parties, voluntary groups and individuals in outlying Local Authority Areas (LAAs) may submit their symbol to the Registration Officer at the GECOM Registration Office in their area.”

“A list of candidates submitted by any political party, voluntary group or individual candidate on Nomination Day must be accompanied by the pre-approved symbol, as this is required for the publication of the list,” the notice said. Under Section 51 of the Local Authority (Election) Act, none can contest the election without submitting their symbol.Parties such as the People’s Progressive Party/Civic (PPP/C), have already signalled their readiness to contest the upcoming LGE. As far back as August, Vice President Bharrat Jagdeo, who is the General Secretary of the PPP/C, had said that the party is in preparation mode for LGE.

“We’re already gone on an election footing. We’d be ready where elections are held this year or next year. We don’t control when that happens, GECOM does but we’d be ready at any time,” the Vice President had stated during a press conference.

“GECOM would have to write indicating when they are ready. But [in] the People’s Progressive Party, I speak as General Secretary, I’ve already convened a meeting and we’ve already started working on our organisational structures around the country. We’ve put our party in a readiness mode,” he had posited.

But with LGE just months away, there has been much uncertainty regarding the Opposition’s participation in the polls. Leader of the A Partnership for National Unity/Alliance For Change (APNU/AFC) Opposition, Aubrey Norton has said that they will not participate in and also threatened to block any elections from being held if the voters’ list is not cleansed.

Since losing the March 2020 elections, the coalition Opposition has been claiming that the voters’ list is bloated. This is despite GECOM already conducting Claims and Objections, a legally mandated method of cleansing the list.

The exercise captured more than 3000 new applicants who will be eligible to vote by October 31, 2022, with only 18 objections to names on the Preliminary List of Electors (PLE).

And based on a 2019 High Court ruling, GECOM cannot remove any person from the National Register of Registrants (NRR) – from which the voters’ list is compiled – unless they are dead or otherwise disqualified under Article 159 (2), (3) and (4) of the Constitution.

There is also no confirmation on whether AFC will seek to contest the LGE alone or in the coalition. AFC was famously forced to contest the 2018 LGE alone without its coalition partner and ended up securing just 4 per cent of the total votes cast.

At a press conference over a week ago, AFC Leader Khemraj Ramjattan had told the media that its National Executive Committee will reveal position the party’s position on LGE after consultations, slated before 2023.

LGE, which are usually due every two years, was last held in 2018. At the last LGE in November 2018, the then PPP/C Opposition had secured 52 of the 80 Local Authority Areas (LAAs). This followed the holding of the LGE in 2016, during which the PPP/C also claimed the majority of the LAAs.

DHBC mounts $1B+ lawsuit against Panamanian company over recent collision

Repair works being conducted to the Demerara Harbour Bridge

The Demerara Habour Bridge Corporation (DHBC) has filed an over-a-billion-dollar lawsuit against the vessel—MT Tradewind Passion—which collided with the floating structure on October 8, rendering it inoperable for just over two days and resulted in a $1 billion repair bill.

The vessel is owned by Canama Trading S De RL, a company registered in Panama.

In its Statement of Claim (SoC) filed at the Demerara High Court, the DHBC said that the collision caused $1 billion and counting in damages and that there has been no compensation despite several oral requests demanding payment of the sum.

As such, the corporation is seeking $50 million in damages for negligence since the master of the vessel was negligent by not exercising the relevant international safety conventions for safety at sea. It said that the master did not apply the applicable speed necessary in the prevailing circumstances. Due to the negligence of the master and the vessel’s crew, the DHBC complained that it has suffered and will continue to suffer extensive losses.

According to the DHBC, the vessel’s master was negligent since he failed to sail at a safe speed; failed to report difficulties being encountered upon approaching the bridge; and failed to use reasonable care and skill in its operation so that the fuel tanker could veer away from, thereby avoiding collision with the bridge. At the time, the vessel was under the control and command of Captain Freddy Mendoza, advised by Pilot Kenneth Cort, who a Board of Inquiry (BoI) into the collision has recommended be suspended for not less than 24 months.

Apart from damages for negligence, the DHBC is further seeking special damages of $1 billion; interest under the Law Reform (Miscellaneous) Provisions Act; such further or other order or relief the court deems just; as well as costs.

Reports indicate that at around 02:00h on October 8, the vessel which transports fuel for the Guyana Oil Company (GuyOil), while heading south, crashed into the Demerara Habour Bridge, despite desperate calls to ‘drop anchor’ from the Shift Supervisor Andy Duke.Duke, who was in one of the lookout towers, tried desperately to communicate with the pilot without success. He eventually had to jump from the booth to save his own life. He fractured his leg in the process and was hospitalised. The other men who were working at the bottom of the bridge, including Mechanical Maintenance Engineer Ahmad Khan, had to run for their lives.

In its particulars of special damages, the DHBC, among other things, listed the cost for anchorage parts including buoys, sheaves, anchor chains, shackles, and wire rope.Also included was the cost of structural components parts including connecting posts, junction pins, panels, sway braces, sway brace bolts and nuts, and deck plates. It is also claiming money for toll revenue loss from October 8 to 10, labour, and meals and refreshments for workers. The DHBC is also suing for projected works it will have to carry out on the bridge.

The claim was filed by PPP/C parliamentarian, Attorney-at-Law Sanjeev Datadin.

The vessel has been detained as the DHBC’s General Manager, Wayne Watson, in an affidavit, deposed that he believes it will be removed from Guyana before the lawsuit is determined.

But Canama Trading S De RL contended that the detention of the vessel, without an application pursuant to Section 439 (1) of Guyana’s Shipping Act being made to the court, constitutes a wrongful and unlawful deprivation, detention, interference with, trespass upon, restraint, or imprisonment of its property and the crew of the vessel. An application has since been made to the High Court for a warrant of arrest to be issued against the ship.

Canama Trading S De RL argued that the detention of the vessel is unlawful as it was done without or in excess of jurisdiction, without reasonable grounds, and not in compliance with statutes and the Constitution of Guyana. As such, it is suing the Maritime Administration Department (MARAD), Harbour Master Glasford Archer, and the DHBC for more than $100,000.

The company said that the vessel is under charter to GuyOil, operating between Trinidad and Guyana, and remains under the instruction of GuyOil for at least another year. Considering this, it argued that there were no reasonable grounds for concluding that the vessel would imminently depart the jurisdiction and therefore wants it to be released immediately. It said that the DHBC has refused to accept full and valuable security it has offered and continues to offer.

The company is claiming loss of use of the vessel at a daily rate of US$12,250.

Canama Trading S De RL has also made an urgent application to the High Court to argue limitation of liability pursuant to Section 402 of Guyana’s Shipping Act as a defence to the DHBC’s lawsuit.

In that application, it is seeking an order that it be entitled to constitute a limitation fund under Section 414 (1) of the Shipping Act by paying or lodging with the court, as security, $244,944,006.21 plus interest thereon at the rate of four per cent per annum from October 8 to the date of the constitution of the fund. According to the company, it reserves all rights to contest any sums claimed by the DHBC, whether on grounds of failure to mitigate, or otherwise.

The collision caused extensive damage to critical components of the Demerara Harbour Bridge, which not only left it inoperable but resulted in thousands of passengers and tons of agricultural produce stranded on both sides of the Demerara River.

While repairs were being carried out on the bridge which was reopened on October 10, water taxis which normally operate for 12 hours, were allowed to work for 24 hours. Given the psychological impact the collision has had on the bridge’s staff who were on duty at the time, with some of them still heavily traumatised, the BoI said that clinical interventions may be needed.

On Friday October 28, 2022, the Ministry of Health, Wellness, and Elderly Affairs reported a total of 18 new cases of COVID-19 from samples processed on Friday, October 21, 2022, toThursday, October 27, 2022.

This is from 565 samples collected from October 18, 2022, to October 27, 2022.

This number of positive cases makes up 3.8% of all the samples processed on these dates.

As a result, the total number of cases diagnosed in the country is currently 29,654.

Confirmation was also received of the recovery of 3 individuals diagnosed with COVID-19, bringing the active cases in the country to date to 16.

Currently, there are two positive COVID-19 cases at the Respiratory Hospital.

Vaccination continues at various Wellness Centres as per the published COVID-19 vaccination schedule and will be available from 9 am to 4 pm.

The Ministry of Health, Wellness, and Elderly Affairs will continue providing frequent updates to the public as new information becomes available.

Le président somalien a lancé un appel à la communauté internationale pour venir en aide aux blessés du double attentat à la voiture piégée qui a fait 100 morts samedi dans la capitale Mogadiscio, alors que les bulldozers continuent lundi de déblayer le site de l’explosion à la recherche de victimes sous les décombres.

Les islamistes radicaux shebab ont revendiqué l’attentat, le plus meurtrier depuis cinq ans, affirmant que leurs combattants avaient visé le ministère de l’Education. L’attaque a également fait au moins 300 blessés.

Deux véhicules piégés ont explosé samedi sur une artère très fréquentée à quelques minutes d’intervalle. 

Les explosions, qui ont soufflé les fenêtres des bâtiments voisins, ont submergé les hôpitaux et cliniques, dans ce pays au système sanitaire ravagé par des décennies de conflit.

La Somalie, pays de la Corne de l’Afrique, est plongé dans le chaos depuis la chute du régime de Siad Barre en 1991.

“Nous appelons la communauté internationale, les frères somaliens et les autres frères (…) à envoyer des médecins en Somalie pour aider les hôpitaux à soigner les blessés”, avait déclaré dimanche le président Hassan Sheikh Mohamud, en soulignant que le nombre de victimes pourrait encore augmenter.

“Nous ne pouvons pas transporter par avion tout ce nombre de blessés (…). Nous demandons à quiconque pouvant nous envoyer de l’aide de le faire”, avait poursuivi le chef de l’Etat, après avoir lui-même donné son sang.

Le premier ministre Hamza Abdi Barre a ordonné la fermeture des écoles pour que les étudiants puissent donner leur sang.

“En guerre”

La Somalie et “ces terroristes sont en guerre”, avait également affirmé le président Hassan Sheikh Mohamud. Pour le chef de l’Etat, ce double attentat montre que les islamistes shebab ont “perdu et (…) sont incapables de contrer l’armée, de sorte qu’ils se sont faufilés pour massacrer des civils innocents”.

L’attaque a eu lieu au même carrefour qui avait déjà été frappé par le plus grave attentat jamais commis en Somalie : 512 personnes avaient été tuées le 14 octobre 2017 par l’explosion d’un camion bourré d’explosifs.

Ali Yare Ali, un responsable local à Mogadiscio, a déclaré à des journalistes qu’entre 7 et 9 corps pourraient encore se trouver sous les débris.

La communauté internationale a rapidement condamné le double attentat. 

La mission de l’ONU en Somalie s’est engagée à se tenir “résolument aux côtés de tous les Somaliens contre le terrorisme” et Washington a vilipendé une attaque “haineuse” et assuré les autorités somaliennes de leur “soutien dans le combat pour prévenir de tels attentats terroristes impitoyables”.

Le mouvement jihadiste des shebab, lié à Al-Qaïda, combat depuis 2007 le gouvernement fédéral soutenu par la communauté internationale. 

Il a été chassé de Mogadiscio en 2011 mais reste solidement implanté dans de vastes zones rurales, notamment dans le sud du pays et mène régulièrement des attaques dans la capitale et les grandes villes de Somalie.

Ces derniers mois, les shebab ont redoublé d’activité en Somalie, pays pauvre et instable de la Corne de l’Afrique, avec notamment un spectaculaire assaut, long d’une trentaine d’heures, fin août contre un hôtel de Mogadiscio. 

Après cette attaque qui avait fait au moins 21 morts et 117 blessés, le président Hassan Cheikh Mohamoud avait promis une “guerre totale” pour éliminer les shebab et appelé la population à se “tenir à l’écart” des zones contrôlées par les islamistes qui allaient être visés par de prochaines offensives.

Les islamistes radicaux shebab ont également revendiqué l’attaque d’un hôtel de Kismayo, dans le sud du pays, le 23 octobre, qui avait fait 9 morts et 47 blessés.

Les forces de sécurité et des milices claniques locales ont notamment lancé des opérations militaires dans le centre du pays, qui ont permis selon les autorités de reprendre du terrain aux combattants islamistes.

Outre l’insurrection shebab, la Somalie est également menacée par une famine imminente, provoquée par la plus grave sécheresse observée depuis plus de 40 ans.

Un homme a été blessé par balle hier soir (dimanche 30 octobre), un peu après 22 heures, dans le bourg de Schoelcher. Son pronostic vital est réservé.

Les faits se sont produits hier soir, un peu après 22h30. « On a entendu des coups de feu et puis on a vu les pompiers et les gendarmes arriver », confie un homme qui se trouvait sur la place à Schoelcher, avec son fils.

À l’arrivée des secours du Service Territorial d’Incendie et de Secours de Martinique, la victime n’était plus présente sur place. Ses proches l’avaient conduit, par leurs propres moyens, au CHU de Martinique.

 

Enquête ouverte

Les gendarmes de la compagnie de Fort-de-France ont immédiatement balisé la zone, à la recherche d’indices. Selon nos éléments, la victime, d’origine sainte-lucienne, est un employé du Wanted, un fast-food situé sur le bord de mer. L’établissement avait déjà été victime d’un vol à main armée fin août dernier.

Une enquête est ouverte sur ces nouveaux faits. Le pronostic vital de l’employé blessé serait réservé à ce stade.

Les partis israéliens tentent lundi un ultime effort pour faire pencher la balance à la veille de cinquièmes législatives en trois ans et demi, qui pourraient consacrer le retour aux affaires de l’ex-Premier ministre Benjamin Netanyahu, accusé de corruption.

A 73 ans, le plus pérenne des chefs de gouvernement de l’histoire du pays tente de rallier une majorité de 61 députés, sur les 120 du Parlement, avec ses alliés des partis ultra-orthodoxes et de l’extrême droite qui a le vent en poupe.

Preuve du suspense ambiant, les derniers sondages créditaient le “bloc de droite” de Netanyahu de 60 sièges, contre 56 pour le Premier ministre sortant, le centriste Yaïr Lapid, et ses alliés.

“Nous allons partout, dans toutes les villes, chez tous les électeurs, chez tous les indécis et nous leur disons: que choisissez-vous? La haine ou vos enfants? La colère du passé ou le bien commun du futur?”, a déclaré lundi M. Lapid lors d’un meeting de son parti Yesh Atid (“Il y a un futur”).

Sur ses affiches de campagne, M. Netanyahu montre son adversaire avec des chefs de partis arabes en disant “Une fois est assez”, qualifiant de “dangereux” le gouvernement Lapid.

Celui-ci avait rallié en juin 2021 une “coalition du changement” réunissant des partis de droite, de gauche, de centre et une formation arabe, Raam de Mansour Abbas, pour chasser du pouvoir M. Netanyahu, accusé par la justice de corruption dans une série d’affaires.

“Nous avons vu ce qu’ils ont fait à la sécurité qui s’est détériorée, nous avons vu ce qu’ils ont fait à l’économie avec l’inflation, nous avons vu ce qu’ils ont fait à notre fierté nationale, la question est donc très simple: si vous voulez que cela se poursuive (…) restez chez vous”, a lancé M. Netanyahu lundi.

Votes perdus?

La coalition de M. Lapid a perdu sa majorité au Parlement au printemps avec le départ d’élus de droite, poussant le gouvernement à convoquer de nouvelles élections, les cinquièmes depuis avril 2019 en Israël, un pays qui peine ces dernières années à accoucher de coalitions ou à les maintenir.

Si la campagne a débuté lentement, elle s’est accélérée ces derniers jours avec les partis religieux qui affichaient des banderoles dans les rues de Jérusalem et les formations arabes qui distribuaient des tracts dans les villes arabes de Galilée.

“Sans nous, la droite formera un gouvernement majoritaire. Pour les stopper, nous avons besoin de vous”, a lancé dimanche en hébreu Ahmed Tibi, un des ténors de la liste arabe Hadash-Taal.

En 2020, les partis arabes israéliens avaient récolté une moisson record de 15 sièges en ayant mené une campagne dynamique sous une seule bannière. Mais cette fois, ils se présentent en ordre dispersé sous trois listes: Raam (islamiste modéré), Hadash-Taal (laïc) et Balad (nationaliste).

Dans le système proportionnel israélien, une liste électorale doit obtenir 3,25% des voix pour faire son entrée au Parlement avec ainsi un minimum de quatre sièges. En deçà de ce seuil, les partis n’ont aucun député.

Divisés, les partis arabes sont donc plus menacés de ne pas atteindre ce seuil et ainsi favoriser la victoire du camp Netanyahu et de ses alliés.

– Sécurité – 

Ce scrutin intervient dans un climat de tensions en Cisjordanie occupée avec deux attaques menées ces derniers jours par des Palestiniens, dont l’une a tué un civil israélien samedi soir à Hébron (sud), une ville autour de laquelle et dans laquelle vivent des colons israéliens.

Dans la foulée d’une série d’attaques anti-israéliennes au printemps, l’armée a mené plus de 2.000 raids en Cisjordanie, un territoire occupé depuis 1967, notamment à Jénine ou Naplouse (nord). Ces opérations, souvent émaillées de heurts, ont fait plus de 120 morts côté palestinien, le bilan le plus lourd depuis sept ans.

“Nous savons que ces élections n’apporteront pas de partenaire pour la paix, et malgré cela, nous disons à la communauté internationale qu’elle doit exiger du prochain Premier ministre israélien qu’il s’engage à mettre fin à l’occupation et au conflit”, a déclaré lundi le Premier ministre palestinien Mohammed Shtayyeh, à Ramallah.

Dans la presse israélienne, une question s’imposait lundi, à savoir si ces violences auront le “dernier mot”, favorisant un vote à droite dans un scrutin âprement disputé, comme le notait le Yediot Aharonot.

Farmers encouraged to improve soil nutrition Loop Jamaica

Minister of Agriculture and Fisheries, Pearnel Charles Jr, is urging farmers to place greater focus on improving soil nutrition as part of measures to increase agriculture production for local consumption and meet export needs.

He said that the Ministry is guiding research for the development and utilisation of new blends of fertilizers that are more cost-effective and will enhance crop yield.

“Ultimately, for Jamaica, we want to achieve food security, which means that we have to increase food production, reduce what we are wasting, and look at the methods and the mechanisms to help farmers do what they do best and to do it in a better way,” he noted.

The Minister was delivering the keynote address at the launch of the Diamond-R/Purkote Controlled Release Fertiliser (CRF) by Hi-Pro at the AC Marriot Hotel in New Kingston on Wednesday (October 26).

The CRF technology makes it possible to match the supply of nutrients with the nutritional needs of plants throughout the growing season.

It is designed to feed plants continuously, with maximum nutritional efficiency while reducing nutrient losses, ensuring uniform growth, optimal yield and superior quality, while protecting the environment.

The release of nutrients perfectly matches the nutritional needs of plants and reduces the number of fertiliser applications and therefore the application costs.

Minister Charles said the new product is “directly aligned” to the Ministry’s ‘Grow Smart, Eat Smart’ campaign, which is aimed at expanding the agriculture sector’s growth and sustainability.

He praised farmers and suppliers of agricultural items for ensuring that the sector remains robust.

Mr. Charles said he is convinced that Jamaica will be able to achieve self-sufficiency in food production and supply the Caribbean region.

The Minister also pointed to the need for increased focus on value-added products to ensure that “nothing is wasted”.

In lauding Hi-Pro, the Minister said the entity has distinguished itself as a company that has always strived for excellence in the quality of products that it provides for its customers.

He said that the fertiliser launch is just another example of the company’s commitment to ensuring that farmers are exposed to the best products available to improve their production and profitability.
