PHILIPSBURG — Suspended Member of Parliament Claudius Buncamper accuses the Council of Advice in a press release of an “apparent dereliction of duty” for its refusal to provide advice on the lawfulness of the constitution’s article 50.2b.
“The position of the Council of Advice is respectfully incorrect and not sustainable,” the press release states. Buncamper adds that this does not take away from the obligation of the parliament and the government to take requisite remedial measures if they are of the opinion that a provision in the Constitution violates higher treaties and/or human rights.
“On June 3 I presented a compelling and detailed analysis to the parliament identifying how article 50.2b has proven to be a violation of international treaties,” Buncamper states in the opening paragraph of his press release.
The release points out the responsibility of the parliament in the field of creating and amending legislation. Since Buncamper sent his request for advice to the parliament on June 3, no action has been taken, other than forwarding his letter to the Council of Advice.
Nevertheless, Buncamper states that the parliament “obviously recognized the national importance of not having an article in the constitution that violates international treaties.” The parliament duly washed its hands of the matter by forwarding the letter to the Council of Advice with a request for providing an advice, something the Council has in the meantime declined to do.
The press release further mentions the “impact and implications of not having the representation of persons duly elected by the St. Maarten electorate. The contested article in the constitution tramples on this right “by a potentially unlawful and thus not binding article in our constitution.”
Buncamper adds for good measure that the position of the Council of Advice is “incomprehensible.” The suspended MP wonders whether the Council would also decline to provide an advice in case the parliament or the government proposes an amendment to the contested article in the constitution. The MP maintains that the parliament is now “unjustly deprived from the advice it solicited.”

If you are in the financial services industry and act as registered office or as a money laundering reporting officer, you may have received a request from the Cayman Islands Monetary Authority (CIMA) recently to complete an AML survey. While a fully completed AML survey is expected in most cases, CIMA may permit, with CIMA’s prior approval, partial or incomplete submissions in limited circumstances.
One example of this where an investment management entity has been deregistered or is in the process of a voluntary liquidation.
If your entity falls within this category, you may email an Incomplete Submission Request to AMLSurveys@cima.ky detailing the following:
Licence or Registration NameLicenced or Registration NumberDate of Licence or RegistrationList of current directorsNumber of ClientsReason for requesting to make an incomplete submission
CIMA will then respond to your request to make an incomplete submission.
If approved, CIMA will typically provide instructions to sign onto the CIMA portal with credentials previously provided, following which you will enter the names of the AML survey preparer and person submitting the AML survey and submit the partially completed form.

Linden fire leaves 3 homeless

Three persons are homeless after an early morning fire destroyed their Amelia’s Ward, Linden, Region 10 (Upper Demerara-Berbice), home on Monday.
Reports are that the fire started at about 10:30h while two persons – the owner’s son and his girlfriend – were inside the home.
An alarm was raised and the Fire Service was summoned to the scene. However, by the time the Fire Service arrived, the flames had spread and caused extensive damage.
An investigation has been launched.

14 homeless after Palmyra fire

A fire of unknown origin on Monday night gutted a house at Lot 77 Palmyra Village, owned by a 52-year-old security guard. Reports are that the fire started at about 08:30 pm.
Speaking with this publication, the owner of the home, Boodnarine Dhanraj, said that the family had just finished praying and lit their diyas. He said he was in the hammock at the bottom of the house and his grandchildren were playing in the yard.
According to Dhanraj, he heard someone shout “fire” and he saw the upper flat of the house engulfed in flames. Dhanraj said that there were no diyas lit in the upper flat of the house. He said that he lived in the house with his wife, six children; two sons-in-law and four grandchildren.
The man related that he built the home three years ago. Persons who may want to help the family rebuild can contact them on telephone numbers (592) 673-3440 or (592) 633-8185.

Kaheem Amaru Layne, 20 years of Valarie High Rise, Britton’s Hill, St Michael for the offence of murder.
Personnel from the Hastings/Worthing Police Station arrested and formally charged Layne in relation to the murder of Corey ‘Beans’ Harvey, which happened on October 1, 2022.
Harvey was stabbed about his body in a night club in St Lawrence Gap and made his way to the police outpost unit where he collapsed and died. The deceased was 31 years old. He died 14 days after his 31st birthday.
Layne appeared in the District ‘A’ Magistrate’s Court on Saturday, October 22, 2022, before Magistrate Graveney Bannister and was remanded into custody at HMP – Dodds until November 18, 2022.
