Sécurité, assurance chômage: l’exécutif entre dans le dur

Plus de policiers et gendarmes, et coup d’envoi d’une réforme controversée des conditions d’indemnisation des chômeurs: l’exécutif a présenté mercredi deux projets de loi sensibles en Conseil des ministres, sur lesquels il espère rallier la droite face à une gauche décidée à en découdre.

Avec ces deux textes, Emmanuel Macron et sa Première ministre Élisabeth Borne entrent dans le dur de ce début de quinquennat, en l’absence de majorité absolue, après un premier exercice plus consensuel cet été sur le pouvoir d’achat, en pleine explosion des prix de l’énergie due en partie à la guerre en Ukraine.

Le texte sur l’assurance chômage ouvre la voie à une nouvelle réforme qui s’annonce comme l’une des plus clivantes avec le budget 2023, en attendant celle hautement inflammable des retraites dont le chef de l’État a dit viser une “première entrée en vigueur” à l’été prochain.

Dans un premier temps, le gouvernement entend prolonger les règles actuelles d’indemnisation, durcies en 2019 et qui expirent fin octobre.

C’est la suite qui déclenche la fureur des syndicats:la volonté de l’exécutif d’aller vers une modulation des conditions d’indemnisation des chômeurs selon la conjoncture, avec l’objectif d’atteindre le plein emploi (soit un taux de chômage d’environ 5% contre 7,4% actuellement) à la fin du quinquennat.

Sur quels critères ? “Lorsqu’il y a beaucoup d’emplois disponibles à pourvoir, le régime doit être plus incitatif pour aller chercher un emploi”, a résumé le porte-parole du gouvernement, Olivier Véran, à l’issue du Conseil des ministres.

– Le gouvernement tranchera –

Cela reviendra, dans le contexte actuel, à durcir les règles, la réforme se devant, selon les mots d’Emmanuel Macron, d’être “plus stricte quand trop d’emplois sont non pourvus, plus généreuse quand le chômage est élevé”.

Le gouvernement va lancer à cette fin une “concertation” avec les partenaires sociaux “à très court terme”, dans les “prochaines semaines”, a indiqué Olivier Véran.

Face au refus catégorique des syndicats de négocier une telle modulation, le ministre du Travail Olivier Dussopt a d’ores et déjà annoncé qu’”à la fin le gouvernement prend(ra) les décisions qu’il doit prendre”.

Pour ce premier texte au menu du Parlement début octobre, les débats s’annoncent agités, particulièrement à l’Assemblée avec la coalition de gauche Nupes et le Rassemblement national.

“Ce n’est pas en tapant sur les chômeurs qu’on créera des cuisiniers, des soudeurs, des chaudronniers (…)”, a déclaré mercredi Sébastien Chenu (RN) sur Public Sénat. Le gouvernement table sur une oreille plus conciliante du côté des Républicains qui ont affirmé s’inscrire dans l’opposition.

– “Personne ne peut être contre” –

Le projet de loi d’orientation et de programmation du ministère de l’Intérieur (Lopmi) prévoit de son côté 15 milliards d’euros supplémentaires de budget en cinq ans pour les forces de l’ordre.

“Cette Lopmi prolonge le réarmement de moyens (engagé lors du premier quinquennat Macron) et vient les sanctuariser pour les cinq prochaines années dans des proportions totalement inédites”, a assuré Olivier Véran.

La Première ministre a annoncé mardi “8.500 postes de policiers et gendarmes” supplémentaires en cinq ans, dont 3.000 dès 2023. Elle a aussi rappelé que 10.000 policiers et gendarmes supplémentaires avaient déjà été déployés au cours du précédent quinquennat.

Le texte, qui sera d’abord présenté au Sénat en octobre, prévoit aussi la création de 11 unités de forces mobiles et de 200 nouvelles brigades de gendarmerie.

“On pense qu’il y aura un consensus assez large, personne ne peut être contre la création d’effectifs”, anticipe-t-on au ministère de l’Intérieur.

Le projet Lopmi a toutefois été raccourci de moitié – il ne compte plus que 15 articles – par rapport à sa version initiale transmise au Parlement avant l’élection présidentielle.

Il ne comprend pas la réforme controversée de la police judiciaire qui rencontre actuellement l’hostilité de nombreux enquêteurs et magistrats.

En juillet, le ministre de l’Intérieur Gérald Darmanin avait aussi expliqué vouloir intégrer dans la Lopmi des dispositions sur l’expulsion des étrangers délinquants. Avant d’annoncer une loi immigration, séparée de la Lopmi.

Le 3 septembre dernier, la presse a ?t? alert?e par des responsables d’organismes de d?fense des droits humains par la mort des d?tenus Tombeau Dieuv? et Oss? Ferdinand. Vingt- quatre heures avant, soit le 2 septembre, les d?tenus Jean Pierre Duralson et Sanon Lif?ne succombaient ? la prison civile de Jacmel.

Difficult?s respiratoires, malnutrition sont, entre autres, les causes de la mort de la plupart des d?tenus, relate Jean Jeudy, secr?taire g?n?ral de Soci?t? Makaya, militant pour le respect des droits humains.

Pour aider les d?tenus ? rester en vie, une partie de la soci?t? civile de Jacmel fait son possible pour alimenter la prison en nourriture. Les gens courtisent ceux qui ont chez eux des vivres alimentaires pour alimenter la prison. Des agents de l’APENA ont ?t? aussi aper?us ? Lavannau, habitation riche en arbre v?ritable et en bananiers, en train de demander de l’aide aux agriculteurs au profit des d?tenus.

Selon Jean Jeudy, la majorit? des 700 d?tenus ? la prison civile de Jacmel sont malades. Les conditions ex?crables d’incarc?ration, l’insalubrit?, la malnutrition rendent vuln?rables les d?tenus qui, pour la plupart, sont en d?tention pr?ventive prolong?e.

La population carc?rale de Jacmel est repartie en 14 des 16 cellules disponibles, les deux autres cellules h?bergent une pharmacie et un dispensaire. Cette semaine, l’agent ex?cutif int?rimaire de la commune a cr?? une cellule compos?e de notables de la ville, des commer?ants pour ?laborer un plan de sauvetage pour cette population carc?rale.

138 Student Living led gains as schools reopen Loop Jamaica

As schools reopen, the dormitory firm 138 Student Living led gains on Tuesday’s trading on the Jamaica Stock Exchange (JSE).

138SL gained 15 per cent to close at $6.97.

The company rents dormitories on the campus of the University of the West Indies, Mona. This period would be a busy period for the company, as students are becoming residents on halls across the campus.

Also on the day, CAC gained 14 per cent to $6.89. On the losing side.

On the other hand, Access Financial dipped 15 per cent to $21.35 and Portland JSX declined 10 per cent to $9.00.

The JSE Index declined by 956.79 points (0.27 per cent) to close at 358,151.39 points and the volume traded amounted to 4,720,134 valued at $42,982,083.97. The Junior Market Index advanced by 4.95 points (0.12 per cent) to close at 4,303.70 points and the volume traded amounted to 45,397,558 valued at $124,937,847.93.d

The JSE Combined Index declined by 848.85 points (0.23 per cent) to close at 373,587.47 points and the volume traded amounted to 50,117,692 valued at $167,919,931.90. The JSE All Jamaican Composite Index advanced by 262.34 points (0.06 per cent) to close at 406,712.92 points and the volume traded amounted to 4,589,713 valued at $31,673,965.09.

The JSE Select Index advanced by 32.43 points (0.35 per cent) to close at 9,181.08 points and the volume traded amounted to 1,002,788 valued at $19,220,887.56.

The JSE USD Equities Index advanced by 2.38 points (1.15 per cent) to close at 208.88 points and the volume traded amounted to 558,777 valued at $100,539.79.

The JSE Financial Index declined by 0.17 points (0.20 per cent) to close at 85.42 points and the volume traded amounted to 6,690,506 valued at $38,953,444.20. The JSE Manufacturing & Distribution Index declined by 0.40 points (0.39 per cent) to close at 101.21 points and the volume traded amounted to 6,599,763 valued at $47,912,215.75.

Overall market activity resulted from trading in 104 stocks of which 46 advanced, 44 declined and 14 traded firm. The market value for local currency trades (excluding blocks) amounted to 50,117,692 units valued at $168 million. The market value for US dollar trades (excluding blocks) amounted to 558,777 units valued at about US$100,500.

Enterprise man shot dead

A 31-year-old Chaguanas man was gunned down on the roadside on Tuesday night.

Dillion Lewis died on the spot at Chrissie Trace in Enterprise near Dollars’ Bar.

A police report said residents heard gunshots at about 7.40 pm on Tuesday and called the police.

Central Division Task Force officers found the body of the labourer lying on its back with gunshot wounds to the head. He was wearing a black jersey and three-quarter black pants.

The police said he lived at Walcott Lane in Enterprise.

Other Central Division police and Homicide Bureau Region III detectives visited the scene.

The police do not have a motive.

No one has been arrested.

Trinidad and Tobago journalist now Turks, Caicos police communications officer

Trinidad and Tobago newspaper reporter Denyse Renne has joined the Royal Turks and Caicos Islands (TCI) Police Force as its communications officer.

This was announced in a post on the force’s Facebook page on Wednesday.

It described Renne as “an experienced communications professional and former decorated journalist who will lead the communications of the police force.”

During her time as a journalist at the Trinidad Express and Guardian, Renne drew the ire of several politicians and former commissioner of police Gary Griffith for stories she wrote.

The release quoted TCI police commissioner Trevor Botting as saying it was a great pleasure to have Renne as part of the RTCIPF team.

“Ms Renne will be able to bridge her professional experience with her passion for interacting with both the community and our stakeholders. I have every confidence in her abilities and capabilities to perform the force’s strategic objectives which include but are not limited to; taking the lead in engaging the public, building the trust of communities and strengthening partnerships.”

The release quoted Renne as saying, “I am humbled and grateful for the opportunity to work alongside the Royal Turks and Caicos Police Force.

“Part of my focus will be ensuring the public receives timely and accurate information and highlighting the exceptional work done by the officers. Additionally, it is my aim , as a passionate communications professional, to increase the civic engagements within communities and the police force.

“One can only accomplish so much when working alone, but having the support, trust and confidence of those you serve makes a difference that is beyond measurable.”

The release ended with a list of Renne’s qualifications.

Renne is the second former local journalist to take up a position in a police organisation regionally in recent times.

Former TTT reporter and news anchor Gary Moreno, who migrated to Bermuda and at one time worked with the Bermuda Broadcasting Company, resigned from that post in 2019 to become corporate communications manager of the Bermuda Police Service.

Norton appeals CJ’s ruling on appointments of PSC Chairman, Integrity Commission

Contending that acting Chief Justice Roxane George erred and misdirected herself in law in upholding President Dr. Irfaan Ali’s appointment of Patrick Findlay as Chairman of the Police Service Commission (PSC) as well as his appointment of the Integrity Commission, the APNU-AFC has filed an appeal.

The action brought in the name of Opposition Leader Aubrey Norton, which was filed on Monday, lists 11 grounds upon which the party is seeking to have Chief Justice Roxane George’s ruling overturned by the Guyana Court of Appeal.

In her ruling delivered virtually on August 23, the Chief Justice dismissed Norton’s bid to have the President’s appointments of Police Service Commission (PSC) Chairman Patrick Findlay and the Integrity Commission annulled, on the basis that the Head of State did not engage him in the constitutionally required meaningful consultation.

Both constitutional commissions were appointed on May 31.

But in finding that the President acted lawfully in appointing Findlay, and by extension the new PSC, she held there was procedural fairness and that the consultation process between President Ali and Norton was “sufficient”.

Even though the PSC was lawfully appointed, she, however, found that it was not properly constituted in the absence of a Chairperson for the Public Service Commission —another constitutional commission that is still to be set up and which is vital to the reconstitution of the PSC.

In the circumstances, she applied the defacto doctrine to give legality to all actions taken by the PSC, including its recent promotion of dozens of senior Police officers.

The Opposition is, however, dissatisfied with the Chief Justice’s ruling except for her finding that the PSC was not properly constituted.

In the case of the appointment of the Integrity Commission, the Chief Justice noted that the President had followed Article 232 of the Constitution in his efforts to consult with the Opposition as well as the Integrity Commission Act.

Besides Findlay as Chairman, Attorney-at-Law Mark Conway and businessmen Ernesto Choo-a-Fat and Hakeem Mohammed are the other members of the new PSC.

The Integrity Commission has Demerara Bank Corporate Secretary Chandra Gajraj as Chairperson; along with Mohamed Haniff; Dr Kim Kyte-Thomas, lawyer and former Solicitor General; Hardesh Tiwari, and Reverend Wayne Chris Bowman as members.

Killers changing tactics, says Chang Loop Jamaica

National Security Minister Dr Horace Chang says gunmen are reducing the number of shooting incidents they are engaged in but increasing the number of killings.

He made the statement Tuesday as he opened the debate on the much-talked-about Firearms (Prohibition and Regulation) Act, 2022 in the House of Representatives.

When passed into law, those found guilty of gun crimes could face a mandatory minimum sentence of 15 years in prison.

Speaking of multiple killings, the volatile Olympic Gardens community in the tough St Andrew South Police Division has experienced three double murders since Sunday evening.

To address the problem, the Government has justified what Chang acknowledged was the “punitive” nature of the legislation by pointing to rampant gun violence that has claimed upwards of 1,200 lives each year and the proliferation of illegal weapons in the society.

“Given this proliferation of illegal firearms in the country it is not surprising that the security forces have reported a steady rate of firearm recovery over the years,” Chang said in his opening remarks.

He said that since 2018, the security forces have taken more than 3,200 illegal firearms and in excess of 53,000 rounds of ammunition from the nation’s streets.

“In fact, the security forces have seized upwards of 625 firearms annually, and based on the firearm seizures so far this year, they are well on course to surpass the 703 firearms that were seized in 2021.

“As the police become more effective at intercepting the killers, however, we find that they are changing their tactics. They are reducing the number of shooting incidents and increasing the number of multiple killings,” said Chang.

Chang told the House that “what we have today in Jamaica, are well-funded and resourced criminals, with relative ease of access to high-powered weapons and other firearms who, are engaging each other in shoot-outs and are attacking the police and killing law-abiding citizens”.

“As a responsible government, knowing the impact that the regional guns-for-drugs trade is having on our country; knowing the pain and suffering that armed gangs and thugs are inflicting on our people, and the havoc they are causing in the communities; and being mindful of the crisis of criminal violence that we have on our hands …we had to take action!” he argued.

Said Chang: “This government had to respond to this crisis with a strong, comprehensive and impactful legislation, with a mandatory minimum sentence that will effectively deter criminals. This piece of legislation is punitive, but more importantly it will help to save Jamaican lives.”

The security minister said the Act was intended to curb the murder projections and stem the tide of criminal violence in the country.

“We know that legislation alone will not reduce the level of homicides overnight. We are confident, however, that this piece of legislation presents a strong deterrent to persons who are involved in trafficking, diversion, manufacture, stockpiling, and the movement of firearms, their parts, components, and ammunition. And we will not apologise for that! This is an effective tool for the police who have been successfully apprehending and prosecuting, but the current system has become a revolving door for hardened criminals,” said Chang.

The Act will repeal and replace the Firearms Act of 1967. It addresses the current criminal landscape in Jamaica and presents a strong response to the proliferation of illegal firearms within our jurisdiction Chang noted.

He highlighted that the consequential amendments made to the Offences Against the Person Act will increase penalty provisions for Sections 13, 16 and 17 by including a mandatory minimum sentence of 15 years for offences involving the use of a firearm. In addition, under section 20(2) the mandatory sentence has been increased from 15 years to 20 years, in keeping with the proposed penalty regime in the current Bill.

‘CoComelon’ grows to include speaking characters, live tour Loop Jamaica

One of Netflix’s most popular children’s series, “CoComelon,” a giggly, musical series with repetitive lyrics, dropped a new special on Monday, providing many parents, like Arinze Odira, of Windsor, Ontario, a reprieve.

“I had a lot of stuff I wanted to do and my wife was sleeping,” explained Odira, whose daughter, Keine, is 13 months. “I put ‘CoComelon’ on and she was there for almost three hours. I had the time to do everything I wanted to do.”

Odira was so thankful, he took to Twitter to share his thanks: “To the producers of ‘CoComelon,’ I owe you guys a bottle of whisky. Thank you for helping millions of parents around the world.”

It may not be as flashy or as high-profile as Netflix’s adult programming, such as “Bridgerton” or “The Crown,” but “CoComelon” is an important show for the streaming service. Besides the US, it’s hit the top 10 in countries including the UK, Philippines, Canada and South Africa.

“CoComelon” and Netflix also plan to go big in 2023 by releasing a new series called, “CoComelon Lane” where the characters speak. Episodes will be set up by main character JJ, a toddler with a tiny curl of hair on the top of his head and two teeth.

“He talks directly to camera, so he talks to the kid at home. It really feels like he’s inviting you into a playdate with him and his friends. He’s asking you to come with him on whatever his journey of the day is,” said Heather Tilert, Netflix’s preschool content executive, who says “CoComelon Lane” is targeted for children a little bit older.

“Cocomelon is really hoping to continue with kids who have fallen in love with JJ and friends already and kind of move with them through their development. So, ‘CoComelon Lane’ we see as really kind of for 3 to 5-years-olds.”

The new hourlong special released this week, called “Fun with Family and Friends,” consists of 20 new musical animated shorts. It’s the first “CoComelon” content exclusively available on Netflix. They’ve upped their music game too, licensing songs parents will recognise including “Twist and Shout” and “Stand by Me,” but touching on skills for reaching pre-school milestones including colours, shapes, movement and even emotions.

“CoComelon” was originally created in 2005 by Jay Jeon, a father in California who had the idea to use songs to teach his own two kids. He began uploading the videos to YouTube. Those videos eventually grew to gain billions of views and “CoComelon” was acquired by Moonbug Entertainment in 2020.

It’s expanded the franchise with spin-offs, a podcast on Spotify and a new live tour called ” CoComelon Live! ” kicking off September 16 in Baltimore.

Tapping into exactly what makes “CoComelon” so popular with kids is “the big question,” said Andy Yeatmen, Moonbug’s managing director of Americas, but he thinks it is due in large part to putting the child first rather than going over kids’ heads to entertain parents.

“Everything is very thoughtful about being from a preschooler’s point of view. So, not what an adult would think about as important to a 3-year-old, but what a 3-year-old would think is important.”
