Radican medida para tener remedios civiles en casos de maltrato de animales

Los senadores Carmelo Ríos Santiago y Migdalia González, radicaron el Proyecto del Senado 896 el cual crea la ‘Ley de Remedios Civiles para la Protección de Animales’ para así establecer remedios civiles como medida para combatir el maltrato, la crueldad, el abandono y el abuso animal en la Isla.

“El maltrato a los animales es un asunto serio y un problema social que ha ido en incremento. Comprende comportamientos que causan dolor innecesario o estrés al animal. Los mismos pueden ser desde la negligencia en los cuidados básicos, hasta ocasionar la muerte. Por otro lado, la defensa de los animales se basa en un principio de tolerancia y respeto hacia la vida, tanto humana como no humana”, según establece la Exposición de Motivos de la medida.

El objetivo de la pieza legislativa es proveer un remedio de naturaleza civil para la protección y el trato digno de los animales, adicional a los remedios criminales disponibles, e independiente de los mismos. Mediante esta nueva Ley se permitiría que cualquier persona, aun aquella que no sea el guardián o poseedor de un animal, fungir como demandante para velar por su protección.

Cuando, a juicio del Tribunal, en una demanda jurada o apoyada por una declaración jurada, se aleguen hechos específicos que establezcan claramente que haya ocurrido un acto de crueldad, abandono o abuso contra un animal, el Tribunal podrá emitir una orden de custodia provisional, de así solicitarlo el demandante, otorgándole el derecho de proveer el cuidado apropiado al animal.

“Los animales son parte de nuestro entorno, son seres vivientes que merecen un trato justo y digno. Estos animales no tienen voz propia ni manera de reclamar sus derechos, por lo que, con la aprobación de esta medida, estamos otorgándole esa voz a través de personas que, preocupadas por sus mejores intereses, están dispuestas a defenderlos. Los actos de maltrato animal no tienen justificación, aun viniendo de su guardián”, expresó Ríos Santiago.

La orden de Custodia Provisional dispondrá la celebración de una vista dentro de 10 días, contados a partir de la fecha en que se expida dicha orden, para que la parte demandada muestre causa por la cual no debe expedirse una orden de interdicto preliminar en lo que se ventilan los derechos de todas las partes. Dicho término podrá prorrogarse si el Tribunal determina la existencia de circunstancias extraordinarias antes de que expire el término de la orden previa.

Un martiniquaise plaisancier a été retrouvé mort noyé à l’Anse Chaudière vendredi vers 16 heures.

Un plaisancier résidant en Martinique a été retrouvé inerte au fond de l’eau à l’anse Chaudière vendredi 2 septembre dans l’après-midi. Âgé d’une quarantaine d’années, l’homme était parti nager depuis un catamaran. Ne le voyant pas revenir, ses proches ont alerté les secours.

Les sapeurs-pompiers ont reçu l’appel vers 16 heures. « Les secours sont arrivés sur les lieux avec la gendarmerie. Il a été repêché au fond de l’eau », indique un officier des sapeurs-pompiers. L’opération a nécessité l’intervention de l’hélicoptère Dragon 972 et de plongeurs des pompiers et de la gendarmerie en interconnexion.

La victime était « complètement inerte » au fond de l’eau, selon les pompiers. La brigade de gendarmerie du Marin indique que la victime résidait en Martinique. Il sera procédé à un examen du corps ce lundi 5 septembre afin de déterminer la cause précise du décès.

Deux Guadeloupéens créent leur marque de montres haut de gamme

L’histoire d’Halchimy, une nouvelle marque de montres, raconte comment deux jeunes entrepreneurs guadeloupéens sont allés au bout de leurs rêves… Ce nom est inspiré du livre « l’Alchimiste » de Paolo Coelho, dans lequel un berger espagnol part à la conquête d’un trésor caché après avoir lui aussi fait un rêve. Kevin Oualli et son frère Nicolas ont fait ce voyage entrepreneurial !

Avant de créer Halchimy, les deux Saintannais sont partis d’un rêve, un vrai, un de ceux que l’on fait en dormant ! « Dans mon sommeil, il y a quelques années, raconte Kévin, j’ai eu une vision : je me voyais en train de manipuler une montre dotée d’un système qui permettait de la rendre modulable. » En se réveillant, Kévin a naturellement cherché sur internet et dans différentes boutiques horlogères si ce concept qu’il avait vu en songe n’existait pas déjà. « Il s’est avéré que non. C’est comme ça qu’on s’est lancé dans l’aventure. » C’était en 2012 et aujourd’hui, les deux hommes sont à la tête de d’une société qui, sous la marque dénommée Halchimy, a déjà sorti deux collections : Audace en 2019 et Intuition 2012 juste avant les grandes vacances. Une troisième collection devrait sortir peu avant la fin de cette année.

Avant d’en arriver là, les deux Saintannais ont dû tout apprendre de l’horlogerie, son vocabulaire, ses rouages et son marché.

A l’origine, Kévin est ingénieur en informatique. A l’issue de son baccalauréat au lycée Poirier-Gissac, il a quitté la Guadeloupe pour suivre ses études supérieures, à Toulouse d’abord, où il a fait un DUT en réseau et télécommunications, puis à Paris, pour une école d’ingénieur dont il sort diplômé en 2011. Son frère Nicolas a lui la bosse du commerce.

« Entre 2012 et 2019, relate Kévin, ça s’est passé comme pour un entrepreneur qui a des idées plein la tête, qui a un projet, un concept qu’il souhaite faire vivre… On a demandé à Google comment on allait passer du rêve à la réalité… Dans un premier temps on a contacté des designers horlogers pour pouvoir matérialiser sur leur outil de conception 3D la vision que j’avais eue… » Et là, ça a été la douche écossaise ! « On a été confronté à pas mal de refus parce que nous n’étions pas du secteur de l’horlogerie… En tout cas, les premiers designers que nous avons rencontrés ne nous prenaient pas forcément au sérieux. » Les deux frères se sont donc perfectionnés sur la connaissance de ce marché et ils ont su au bout de quelques années fédérer autour d’eux une vraie équipe de professionnels qui leur a fait confiance et qui leur a permis de lancer leur première collection en 2019. « Pour se financer, poursuit Kévin, ça n’a pas été facile du tout, les premières années ont été compliquées parce que nous avons dû investir nos deniers personnels. » Mais Kévin croyait en son rêve ! Et ce rêve au début tenait en un mot : le bracelug.

Police in some sections of the Corporate Area say they have not seen the massive pile-up of traffic that many people were anticipating with the start of the school term.

“Members of the security forces have been out in their numbers from early Monday and so far things are progressing slowly,” one officer seen at the intersection of Lindsay Crescent and Washington Boulevard reported.

The policeman, who was part of a team of officers directing traffic at the location, said despite not seeing the rush, officers would continue to maintain a presence in the event activities intensified in the coming days.

Scores of parents and teachers were seen making their way to schools as educational institution reopened their doors after the summer break.

“Parents and teachers alike said while it was early days yet, they were happy with what they were seeing as there were no reports of incidents at the institutions.

Students show up for school in San Fernando

Scores of the students of schools in San Fernando and environs showed up on Monday, the opening of the school year.

Many parents, as well as staff, did not seem to have heeded the call from the TT Unified Teachers’ Association (TTUTA) for teachers to “rest and reflect” at home. The call was to express their dissatisfaction over outstanding wage negotiations.

Even the rain did not stop students from going to school.

At Presentation College, many parents accompanied their children to the entrance.

Vidyia Siewsankar, of La Romaine, saw her son Ryan,12, to the gate.

She said it was her son’s first day at the school and he was excited to be there.

At St Gabriel’s Girls’ RC Primary School, Sheldon Roberts and other parents dropped off their children. Sheltering his daughter Emma, nine, as they walked to the entrance, he said it was customary for him to go to school on the first day.

“I always went to school regardless of what was happening. My daughter also wanted to come.

“I understand what TTUTA is asking, and I agree with the reason for it, because this education system needs to be revamped. Many people need an increase in salaries,” Roberts told Newsday.

“I also think the Government should put mechanisms in place to deal with greedy business owners. Some of them are ridiculous and very selfish.”

At San Fernando Boys’ RC School, Dana St Laurent dropped off her son Nikolai St Laurent, eight. She criticised the association’s call, saying members had significant time during the July-August vacation to rest and reflect.

“My son is now in standard two, and I also just dropped off my daughter (Natalia, 12) at St Joseph Convent. She is now starting school there.

“The call by the association was senseless.”

Students and staff were also seen heading to the Naparima Girls’ High School.

The gates at Grant Memorial Presbyterian School were closed. There were no classes owing to ongoing repair work.

Parents have been told the repairs are set to be completed by Tuesday, and classes are to start on Wednesday.

Children injured in Couva crash on way to school

Several primary schoolchildren were injured in a crash on their way to school on Monday.

The crash happened around 8 am on the Southern Main Road in Savonetta, Couva.

The police said the driver and about ten students were taken for treatment at the Couva district health facility.

Monday marked the first day of the school year.

The police said the driver was heading in a private bus to Couva, a short distance from Pranz Gardens, taking the students to schools in the California/Couva area.

Details are sketchy, but investigators believe the driver lost control and the bus veered off the wet road, flipped and landed upside down in an overgrown area.

Drivers stopped and helped the children out of the bus.

Officers from Mon Repos, Savonetta and Couva fire stations responded.

Couva police are investigating.

TTUTA protest, repairs keep some Tobago schools closed

Several of Tobago’s schools stayed closed on Monday, the first day of the new school year.

The TT Unified Teachers Association (TTUTA) maintained its call for teachers to stay home on Monday to “rest and reflect” on the State’s treatment of them.

TTUTA was offered a four per cent increase in salaries, across the board, similar to other public-service employees. Last Friday, TUTTA’s general council rejected the offer in a letter to the Chief Personnel Officer (CPO).

Newsday visited several schools in the western part of the island.

Parents of the children at Signal Hill Government Primary School were forewarned by the school’s administrator on Sunday evening to keep their children at home.

The message posted in the school’s group WhatsApp chat said: “Teachers are expected to heed the call of TTUTA to rest and reflect tomorrow Monday. There will be challenges in the supervision of students. In light of this, the promotion process will take place on Tuesday 6th September.”

A mother at the St Andrew’s Anglican Primary School said she met locked gates at the school, as she had not been informed of the teachers’ absence.

“I know of TTUTA’s call, but the school really said nothing. I got there to drop off my child, and as excited as she was for day one, we were informed by the security personel on duty that there is no school.”

At the Mt St George Methodist Primary School, students were also turned away.

Classes at the Speyside Secondary School also remained closed on Monday.

A press release from the THA Division of Education, Research and Technology at 11pm on Sunday said the school will reopen on Tuesday.

It said at a virtual meeting which included the secretary, assistant secretary, school supervisor III, project manager of the Project Implementation Unit and the school principal, they decided collectively to use Monday to complete all high-priority projects at the school.

U.S. Coast Guard Rescues Fisherman In Distress Off U.S. Virgin Islands – St. Lucia Times News

 A Coast Guard MH-60T Jayhawk helicopter aircrew rescued a spear fisherman in distress on the rocks just off Dog Island, U.S. Virgin Islands Sunday.

The survivor, a man reportedly over 50-years-old, was injured and holding on as six-foot seas from passing Tropical Storm Earl crashed against the rocks.

“This was a challenging case in a tropical storm with heavy seas, gusty winds, and low visibility, but this is what the Coast Guard trains for,” said Lt. Shea Smith, Coast Guard MH-60T Jayhawk aircraft commander for the case. “I’m proud of the crew, everyone came together as a team to safely and efficiently execute the mission.  Fortunately, the survivor was able to hang on until we could arrive and we are all glad that he is safe.”

Coast Guard watchstanders in Sector San Juan received a call at approximately 8:30 a.m. Sunday from a St. Thomas 911 emergency dispatch operator, who relayed a distress communication from the friend of the fisherman on scene aboard 26-foot Grady White vessel.

Coast Guard watchstanders directed the launch of a Boat Forces St. Thomas 33-foot Special Purpose Craft and a MH-60T Jayhawk helicopter from Air Station Borinquen.

Once on scene, the Coast Guard boat crew attempted to pass a heaving line to the injured fisherman but the crashing waves prevented the crew from getting close enough to reach him.

  The Coast Guard helicopter then moved in and deployed the aircraft rescue swimmer who used a harness to secure and hoist the survivor from the rocks.

The Coast Guard aircrew transported the survivor to the Cyril E. King airport in St. Thomas, where he was transferred to awaiting Emergency Medical Service personnel and transported to the Schneider Regional Medical Center.
