Federal court rules that House committee can access Trump’s tax records

NBC News: A federal appeals court unanimously ruled Tuesday that a House committee can access former President Donald Trump’s tax records following a yearslong legal battle.

A three-judge panel of the D.C. Circuit Court of Appeals agreed that the House Ways and Means Committee has the authority to obtain Trump’s tax records from the Treasury Department, upholding a district court ruling from late last year.

Trump’s lawyers are all but certain to appeal the ruling. NBC News has reached out to a Trump spokesman and a member of his legal team for comment.

Former US President Donald Trump [File: Jonathan Ernst/Reuters]The court ruling adds to Trump’s legal woes following an FBI search of his Mar-a-Lago home on Monday. A source familiar with the matter told NBC News that the search was tied to classified information Trump allegedly took with him from the White House to his Palm Beach resort in January 2021.

Tuesday’s appeals court ruling is the latest twist in a multi-year legal fight over his tax records. A federal judge in December tossed out Trump’s lawsuit seeking to block the House panel from obtaining his tax returns, rejecting the former president’s claim that Congress had no legitimate need to look at the returns and that Congress was simply snooping around in an effort to embarrass him.

House Ways and Means Committee Chairman Richard Neal, D-Mass., on Tuesday lauded the appeals court’s “long-anticipated” opinion. Neal first requested copies of Trump’s federal tax returns in April 2019, a request the Treasury Department initially refused.

“With great patience, we followed the judicial process, and yet again, our position has been affirmed by the Courts,” Neal said in a statement. “When we receive the returns, we will begin our oversight of the IRS’s mandatory presidential audit program.”

Neal had initially cited a federal law that requires the Treasury Department and the IRS to turn over individual tax returns when demanded by any of the three congressional tax committees.

“The Chairman has identified a legitimate legislative purpose that it requires information to accomplish,” the appeals court ruling states. “At this stage, it is not our place to delve deeper than this. The mere fact that individual members of Congress may have political motivations as well as legislative ones is of no moment. Indeed, it is likely rare that an individual member of Congress would work for a legislative purpose without considering the political implications.”

The ruling means Trump would have to ask the full circuit court to rehear the case or appeal directly to the Supreme Court. House Speaker Nancy Pelosi, D-Calif., called the court’s decision a “victory for the rule of law,” in a statement Tuesday.

“Access to the former president’s tax returns is crucial to upholding the public interest, our national security & our Democracy,” Pelosi said. (NBC NEWS)

Rapper Fetty Wap jailed after alleged FaceTime death threat Loop Barbados

Black Immigrant Daily News

The content originally appeared on: Barbados News

Rapper Fetty Wap was jailed Monday after, prosecutors say, he threatened to kill a man during a FaceTime call in 2021, violating the terms of his pre-trial release in a pending federal drug conspiracy case.

Wap, whose real name is Willie Maxwell, told the man, “Imma kill you and everybody you with,” and flashed a gun during the December 11 video call about two months after his arrest in the drug case, prosecutors said.

US Magistrate Judge Steven Locke, acting on a request from prosecutors, revoked Maxwell’s bond and sent him to jail following a hearing Monday in federal court on Long Island.

Messages seeking comment were left with Maxwell’s lawyers. The “Trap Queen” rapper is scheduled to perform in Mobile, Alabama, on August 19 and Austin, Texas, on August 27, according to his website.

Maxwell was initially arrested last October on charges alleging he participated in a conspiracy to smuggle large amounts of heroin, fentanyl and other drugs into the New York City area.

Maxwell, who pleaded not guilty, was released after posting a $500,000 bond, secured by property he owns in Georgia, and agreeing to certain conditions, including that he not violate any federal, state or local laws while on release and that he not possess a gun or other weapon.

Prosecutors say evidence, including a recording of the FaceTime call, showed probable cause that Maxwell knowingly violated the conditions of his release.

During the call, Maxwell repeatedly threatened, “I’m gonna kill you” and was seen holding a gun and pointing it at the screen, according to an FBI affidavit filed on the court docket. After the man on the other end of the call called Maxwell a rat, Maxwell responded by saying, “Your man is a rat,” according to the affidavit.

Prosecutors did not identify the person Maxwell is accused of threatening, referring to the man in court papers only as John Doe.

In the underlying drug case, Maxwell and five co-defendants are accused of conspiring to possess and distribute more than 100 kilograms (220 pounds) of heroin, fentanyl and crack cocaine between June 2019 and June 2020.

The scheme allegedly involved using the US Postal Service and cars with hidden compartments to move drugs from the West Coast to Long Island, where they were stored for distribution to dealers on Long Island and in New Jersey, prosecutors said.

Maxwell rose to prominence after “Trap Queen,” his debut single, reached Number 2 on the US Billboard Hot 100 chart in May 2015.

He has had other brushes with the law, including a 2019 arrest in Las Vegas for allegedly assaulting three employees at a hotel-casino. He was previously arrested in November 2017 and charged with DUI after police said he was drag racing on a New York City highway.

Top performers’ teachers overjoyed but not surprised Loop Barbados

Black Immigrant Daily News

The teachers who stand proudly behind this year’s Barbados Secondary Schools’ Entrance Examination’s top performing girl and boy were “surprised but not surprised” with their results.

Loop delivered the news unknowingly to the principal and teacher of Renelle Best over at St Gabriel’s Primary School. But it was a joy to watch as J4 teacher Susanna Gall held her chest and congratulated her student saying that she deserves it.

Moving her hand between her chest and her mask as she seemingly fought to catch her breath with not only the fact that Renelle got a raw score of 100 in both Mathematics and English, it was a fresh set of breathlessness when she processed that Renelle is the overall top student on the island for this year’s sitting.

Gall said:

“The words are…not coming. I am indeed speechless in a positive way.

“I am extremely happy for her cause she has consistently worked at that excellent peak… So I’m excited but still not surprised!”

Meanwhile, over in St George at St George Primary, a quiet and more composed Kathy-Ann Spencer said, “I’m so proud of him…I did not expect this, but I’m not surprised because he has been working consistently well throughout the two years that I taught him and I know that he was working well even before he came to me in Class 3. Sometimes we tend to forget the teachers who taught these children when they are younger but that preparation and that standard of excellence began from way down in Infants.”

San Francique home undermined by WASA leak

Black Immigrant Daily News

ATTORNEY Prakash Ramadhar is seeking help for members of the Narine family, whose house at Pluck Road/Santa Cecelia Trace, San Francique, was damaged by a nearby landslip.

Ramadhar sent a pre-action protocol letter to the Water and Sewerage Authority (WASA) chairman Ravindra Nanga on Saturday. A copy of the letter was also sent to the Ministry of the Attorney General and Legal Affairs on the same day.

Speaking to the media outside the Narines’ house on Tuesday, Ramadhar said water from a nearby WASA line had started to gush into their property again and further undermine it. The Narines have been experiencing this problem since last February.

“We have been concerned about that. The viability of the home is a real concern.”

He claimed WASA had not taken any responsibility.

Ramadhar said there is always leakage into the Narines’ property from the line whenever there is water in it, and that happened most recently on August 6.

Attorney Prakash Ramadhar (left) speaks to the media on behalf of the Narine family (at back) outside their Pluck Road, San Francique home, where a landslip has been threatening to destroy their home. – ANGELO MARCELLE

He was concerned about efforts by the Works and Transport Ministry to have the house classified as a ruinous structure.

According to Section 176 of the Municipal Corporations Act, an engineer assigned to a local government corporation can classify a structure as unfit for use or occupation. Such structures are defined as ruinous. The owners of such structures can subsequently be directed to demolish, secure, repair or rebuild part or all of the structure.

Referring to copies of letters between the Works and Transport Ministry, Rural Development and Local Government Ministry and the Siparia Regional Corporation, Ramadhar said the corporation’s engineer assessed the property and determined it was not a ruinous structure.

Ramadhar believed the Works and Transport Ministry should have been speaking with the Narines with respect to either helping to repair their home or having them properly compensated if they have to move.

But, he said, “They (Works and Transport Ministry) attempted to do something under the guise of law which I consider to be dishonourable.”

Ramadhar argued that the ministry is liable for the damage to the Narines’ home because it did not maintain the nearby road properly. He claimed the ministry has adopted a similar position elsewhere.

As Ramadhar spoke, vehicles tried to pass behind him along the road.

“Even a 4×4 (pickup) is having trouble to pass,” he said.

Ramadhar promised to represent the Narines legally in this matter “as far as it goes.”

The pre-action protocol letter to WASA invites the authority to inform Ramadhar within 14 days of its plans to address the Narines’ concerns about the damage to their property.

Ramadhar said, “We want to ensure that this family and many others who are in this situation understand that the law protects them, and the liability for those who do not live up to their legal responsibility remains.”

Asked about the best outcome for the Narines, Ramadhar said it would be difficult to restore their home to its former state.

Should WASA accept responsibility for the damage to the property caused by the water line, Ramadhar said they would negotiate with WASA .

Those talks would involve giving the Narines adequate compensation either to repair their home or to relocate.

Emma Narine Mohammed related the continuing stress the family endures because of the landslip and leaking water line.

The house is owned by Mohammed’s parents, Ramhit and Marilyn Narine. Mohammed said 43 years ago, her parents bought the land which the house occupies. The family’s first house was built there in 1984 and was rebuilt in 2015.

Mohammed, her parents, her husband Cedric, her sister, her sister’s husband and their three children currently live in the house.

“It’s horrible only when there is a WASA leak because you can’t sleep.”

Mohammed said the sound of water gushing into their property keeps family members awake morning and night.

“Water causes damages and we don’t know with that kind of water coming down there, if it (house) could just drop down.”

She was concerned for the safety of her sister’s family, who live downstairs.

“The house could drop down on them and they could end up dying.”
