THE CENTRAL Bank has again lost its challenge against the granting of leave to Maritime Life (Caribbean) Ltd to pursue a claim over its exclusion in the bid for Clico and British American Trinidad (BAT) in 2019.

In its lawsuit, Maritime accused the bank of acting irrationally, unfairly, and unconstitutionally by entering into sale and purchase agreements with Sagicor Life for an undisclosed sum.

In challenging the sale, the insurance firm was granted leave by Justice Devindra Rampersad in April last year. He also granted an interim injunction preventing the bank from finalising the transfer of the portfolios to Sagicor.

Maritime’s bid for the Clico portfolio was approximately $7.86 billion, and $516.8 million for BAT. It claimed its bid was some $400 million more than Sagicor’s.

The bank appealed Rampersad’s leave but in February 2021, Justices of Appeal Ronnie Boodoosingh and James Aboud held, in separate but unanimous decisions, that Rampersad was not wrong and dismissed the bank’s appeal. Justice Peter Rajkumar dissented.

The Central Bank then appealed to the Privy Council which on Thursday said it agreed with the initial analysis of Rampersad and the majority in the Court of Appeal that “there is evidential material which gives rise to an arguable case with a realistic prospect of success that the appellant acted unlawfully in terms of the public law standard, by affording unequal treatment to the respondent in comparison with Sagicor.”

Presiding over the bank’s appeal were Lords Hodge, Sales, Stephens, Hamblen, and Leggatt. Stephens wrote the unanimous decision.

Stephens pointed out that in judicial review claims, the preferred course was to proceed to hear the merits of the case unless there is some “clean knockout blow.”

The threshold was even higher, he said, when two previous courts had upheld the granting of leave to Maritime.

Of the bank’s appeal, Stephens said, “The Board has examined with care the detailed critique of the evidential material provided on behalf of the appellant but considers that it does not approach the requisite standard of some exceptional circumstance.”

The law lords also said the grant of leave in judicial review claims should not become an instrument of delay and increased costs with a series of appeals.

They said judicial review proceedings affect not only the parties but also the public interests.

In their ruling, the law lords also threw out an argument by the bank of Maritime’s constitutional challenge argument. Maritime said it had a constitutional right to equal treatment which was breached by the bank in that it did not receive the same standard of treatment that Sagicor did.

In their ruling, appellate judges Boodoosingh and Aboud pointed out that a substantial amount of public funds were invested in the insurance companies, providing a “plant for scrutiny of the decisions (of the Central Bank).”

In its claim, Maritime alleged Sagicor’s bid was a conditional one yet it was accepted outside the bidding requirements and there was no due diligence over the bidding process.

Representing the bank were Ian Benjamin, SC, Kerwyn Garcia and Dionne Springer.

Edward Fitzgerald, KC, Fyard Hosein, SC, Joseph Middleton, Sasha Bridgemohansingh, Aadam Hosein and Anette Mamchan represented Maritime.

LATT to make its indeminity deal position known on Friday

Law Association president Sophia Chote, SC. –

CHASTISED for its “deafening silence” on the collapse of the prosecution of former attorney general Anand Ramlogan, SC, and ex-UNC senator Gerald Ramdeen, the executive council of the Law Association (LATT) was locked in discussions on the issue up to late Thursday night.

LATT’s council met in session from 4 pm and just after 8 pm, president of the association, Sophia Chote, SC, told Newsday the council met for several hours of discussions and was in the process of preparing a release.

She said the release will be available on Friday.

The association came under heavy fire this week for not speaking out on the collapse of the case although several other groups of attorneys and senior attorneys have publicly expressed their outrage over the affair.

LATT’s meeting came ten days after Director of Public Prosecutions Roger Gaspard, SC, made the shocking announcement that the State could not proceed with the case against Ramlogan and Ramdeen because its main witness, convicted King’s Counsel Vincent Nelson, was refusing to testify, for now.

In announcing the decision to discontinue the corruption case, on October 10, Gaspard, SC, said Nelson was not willing to give evidence in that matter until his civil claim for an alleged breach of an indemnity agreement with Government for his testimony came to an end.

Vincent Nelson, KC. –

Nelson, 64, is now suing the State for over $96 million for: loss of earnings after being expelled from a prestigious UK firm; loss of insurance benefits; the $2.5 million fine he was ordered to pay when he pleaded guilty; and additional sums if the UK authorities make demands on him for alleged unpaid taxes.

He claims the Government reneged on the conditions of the indemnity agreement. His claim was filed in January, and is expected to come up for hearing in December, although he has since asked the court to unseal it since he said he never gave instructions to his former attorneys to have it sealed.

In a statement on Wednesday, signed by CBA president Israel Khan, SC, the association said accused LATT of its “decided refusal” to act in accordance with its mandate under section 5 of the Legal Profession Act and its responsibility to citizens.

The CBA called on the council to issue comprehensive statement to “help shape the national discourse on this important issue.”

Dr. Jimmys Cannabinoid Sunscreen has Arrived!

Following many months of product development and testing, Dr. Jimmy’s unique Pre-Sun SPF 30 sunscreen is now available for sale.

“This sunscreen will help protect skin from harmful UV rays and stop skin oxidation and aging in its tracks.  This product will be the best product for people to use and enjoy the sunny beaches of the Caribbean and Hawaii and for skiers enjoying a day of shredding the trails” says Dr. Jimmy’s Co-Founder Elvis Edwards.

Ingredients for Dr. Jimmy’s Pre-Sun formula were carefully chosen to be safe for the environment and has been extensively tested for its ability to block harmful UV rays.  Pre-Sun is a broad spectrum sunscreen that blocks both UVA and UVB rays.

Both cannabidiol (CBD) and cannabinol (CBN) have been incorporated into the formula for their antioxidant properties and to specifically block harmful effects caused by UVA and UVB exposure.

“Although it has taken over a year to develop and test Dr. Jimmy’s Pre-Sun, it was very important to get this right.  We are extremely happy with how the product has turned out.” Says Drew Farwell, Doctor Jimmy’s co-founder and head of marketing.  “Most do not understand that SPF30 only blocks 93% of UV rays from the skin.  We felt it extremely important to add cannabinoids to help further protect the skin from premature aging due to the sun” adds Elvis Edwards.

A trial one ounce Pre-Sun is available in limited quantities with the standard 2.5 ounce sunscreen ready for orders.

Pre-Sun is a perfect companion to Doctor Jimmy’s Flagship After Sun skin moisturizer developed to help the skin heal after a great day enjoying the sun.

About Dr. Jimmy’s:  A Colorado-based minority owned company focused on developing skin care products to support an active outdoor lifestyle.

The company launched in 2021 with a commitment to developing unique skin care products, sustainability initiatives and supporting non-profits that provide improved access for appreciating the outdoors.

USAID Launches Program to Improve Youth Justice Systems the Eastern Caribbean

The United States Government, through the United States Agency for International Development Eastern and Southern Caribbean (USAID/ESC) is pleased to announce a new US$5.3 million grant to the Organization of Eastern Caribbean States (OECS) Commission to implement the Opportunities to Advance and Support Youth for Success (OASYS) project in the Eastern Caribbean over the next four years.

The project aims to reduce crime and violence rates among young people across the Eastern Caribbean and will focus on strengthening youth justice systems in Antigua and Barbuda, Dominica, Grenada, Saint Kitts and Nevis, Saint Lucia, and Saint Vincent and the Grenadines.

OASYS will strengthen existing, and invest in new, programs that provide skills development, psychosocial support, and family interventions for youth in conflict with the law through collaborations with government and non-government partners, civil society organizations, and the private sector.

OASYS will also support partner countries to implement and institutionalize a case management system to monitor young offenders from their initial contact with law enforcement through to his/her successful reintegration into society.

At the project launch in Saint Lucia, Acting USAID/ESC Regional Representative David Billings emphasized, “The United States is committed to working with the OECS, national governments, civil society organizations, the private sector, and most importantly young people and their communities, to provide opportunities for youth to succeed.”

In her remarks at the signing ceremony, Dr. Carlene Radix, Head of the Human and Social Division for the OECS, commented, “The OECS and USAID Youth Justice Project expands on earlier initiatives which contributed to the transformation of the child justice landscape, and allows for the strengthening of implementation in the spirit of the existing legislation and with the collaboration of the community.”

No trust in Truss:  General elections should be called

Black Immigrant Daily News

The content originally appeared on: Antigua News Room

By Sir Ronald Sanders

(The writer is Antigua and Barbuda’s Ambassador to the United States of America and the Organization of American States.   He is also a Senior Fellow at the Institute of Commonwealth Studies, University of London and Massey College in the University of Toronto)

The present Conservative party in Britain has now established a remarkable list of records; none of them good.

Liz Truss, who has now resigned as leader of the Party and Prime Minister, has the record for serving the shortest period as Prime Minister in the history of Britain. Kwasi Kwarteng, who she appointed as Finance Minister, has the notorious distinction of serving the shortest period in that position, except for one previous occupant who died of a heart attack.  Suella  Braverman, Liz Truss’ Home Secretary, also holds the record for the briefest period in that office.

But the greatest record of all is that Liz Truss’ short-lived government has succeeded in wrecking the British economy in almost blinding rapidity.  In six short weeks from  her assumption of office, the British economy plunged into freefall with disastrous effects.  The value of the British currency plummeted; pension funds lost billions of dollars, depriving thousands of persons of their pensions; and mortgage costs for millions of people skyrocketed overnight.

She should have resigned then.  But claiming that she was “a fighter not a quitter”, she fired Kwarteng instead.  He was to be the sacrificial lamb on the altar of her own ambition, when even casual observers of politics knew that Kwarteng’s disastrous budget, which cut taxes for the rich among its other disasters, could not have been presented without her participation and approval.

Forced to appoint a new Finance Minister, Jeremy Hunt, who was opposed to her leadership, she bold-facedly swallowed any dignity she may have had by approving his new budget, which reversed all the measures of the previous Kwarteng budget including all the policies for which she claimed to represent.

Such was the depth of her lust for power.  But it is not she alone.  No leader clings to power against obvious odds without the encouragement and urging of a coterie of persons whose political and economic fortunes are tied to that leader.  That coterie is now either scrambling to find some other person, who would serve their interests, or they are busy trying to influence persons in the opposition Labour Party.

The Conservative Party has only itself to blame for its present highly detested position in the British body politic.  Liz Truss was elected by party officials over Rishi Sunak, a former Finance Minister.   Sunak is of Indian origin and while the Conservative party has done more, in recent years, to recognize the quality of immigrants and their contribution to British economic development than the Labour Party, the same underlying prejudice that gave BREXIT its success, resulted in Truss’ triumph over Sunak.  They will not admit it, but many in the Conservative party establishment could not stomach an immigrant as their leader and Prime Minister.

While that view was not dominant among the Conservative members of parliament who favoured Sunak over Truss, it was the natural instinct of the Conservative rank and file.

It should be noted that, in the debates between the candidates leading up to the election of Truss by officials of the Conservative Party, Sunak had time and again questioned the economic and financial policies that were espoused by Truss.  Sunak argued against tax cuts advocated by Truss, focussing instead on fighting soaring inflation and using targeted measures to offer support to those most in need.   As former Finance Minister, he knew that Britain was already in a precarious financial position and that making tax cuts, which benefitted corporations and the rich, would leave a gaping hole in revenues.

Even in these circumstances, Truss was not a popularly elected leader of the Conservative Party.  She secured 57 % of the members’ votes, compared to Boris Johnson’s 66.4 % in 2019, David Cameron’s 67.6% in 2005 and Iain Duncan Smith’s 60.7%  in 2001.

Now with no trust in Truss, and a vacancy existing again for the office of leader of the Party, Conservatives have to elect a new leader by October 31.  The talent pool has narrowed considerably.  Therefore, three names have quickly emerged – Rishi Sunak, Penny Mordaunt who was a contender in the last contest; and, lo and behold, Boris Johnson who had predicted his own return with the words “Hasta la vista, Baby”, not goodbye, when he was forced to resign.  Per force, in the bargaining that will ensue in the battle, no person with solid party backing will emerge.

The question is: for how long will the Conservative party last as the Government?   The party is now a gravely wounded organization, divided inside and disliked outside.   Not only does it not have the capacity to heal its self-inflicted wounds, but it is also clear that, apart from its die-hard supporters, the British public wants the Party gone from office in the interest of attaining a higher level of political stability, and the chance to rebuild their tattered economy.

The best option for Britain is to take the matter of the leadership of the country out of the self-interested hands of Conservative party officials and locate it where it now cries out to be placed; and that is in the votes of the British electorate.

Unfortunately, no person, elected as leader of the party in the next few days, would be willing to take the decision to call a general election to seek a fresh mandate from the people.

The next general election must be called by January 2025.  This means that if the next Conservative party leader decides to hold out until then, Britain faces the real possibility of political turmoil for the next 2 years and 3 months, and with it can come further economic collapse.

The one guarantee in all this is that the Labour Party and its leader, Sir Keir Starmer, will be relentless in their efforts to remove the Conservative party from government.  Without an early general election, the British people and their economy are set for a torrid time.
