Criminal Bar condemns Nelson’s ‘indemnity’ deal

Vincent Nelson,
KC

THE Criminal Bar Association (CBA) has condemned “in the strongest possible terms” the indemnity agreement between the Government and convicted King’s Counsel Vincent Nelson, particularly if promises were given without the knowledge and consent of the Director of Public Prosecutions for him to give evidence against former attorney general Anand Ramlogan, SC, and ex-UNC senator Gerald Ramdeen.

In a statement on Thursday, the CBA said it had received a “voluminous” number of documents involving the failed criminal prosecution of the two attorneys.

“Our initial perusal of some of those documents has caused us some disquiet, it commented, adding that after the CBA’s executive “comprehensively reviewed and digested these documents,” it intends to make a statement on the role of former attorney general Faris Al-Rawi and the DPP’s decision to discontinue the case.

The CBA also called on DPP Roger Gaspard, SC, to make a “detailed and transparent statement” of his reasons for discontinuing the charges against Ramlogan and Ramdeen.

The CBA said it would be instructive to know the DPP’s reasons, otherwise it could give the public the impression that there was one law for the rich and powerful and another for the poor and dispossessed, as articulated by attorney Martin George.

In the statement, the president of the CBA, Israel Khan, SC, also commended Gaspard for the position he took on Monday when he announced he was discontinuing the criminal prosecution against Ramlogan and Ramdeen.

At Monday’s hearing, Gaspard said Nelson was not willing to give evidence in that matter until his claim for breach of the alleged indemnity agreement came to an end.

Gaspard said it would be unfair to leave the case against the former AG and UNC senator in limbo until the outcome of Nelson’s civil claim, in which he is alleging the State did not keep its side of the bargain on the indemnity agreement.

Gaspard came in for praise from Chief Magistrate Maria Busby Earle-Caddle and the men’s attorneys.

The CBA said Gaspard “demonstrated integrity, independence and enviable courage” in his actions, which would have a “positive rippling effect in maintaining public confidence” in the office of the DPP and the criminal justice system.

“It is unmistakably clear that the decision to discontinue such an expensive and high-profile criminal prosecution was a fair, just and reasonable one, made to protect the independence of the high constitutional office of which he is the custodian and to jealousy guard his office from executive interference.”

West: Ignore ‘shiny objects,’ it’s a great budget

MINISTER of Public Administration Allyson West urged people not to fall for distractions – which she dubbed “shiny objects and fads” – but to be confident that the Government was acting in the population’s best interest in its budget, during a debate in the Senate on Thursday.

Without infinite revenues it was impossible to satisfy all needs, she said, so the Government must now prioritise, have a plan, and be ready to make tough decisions. The Government’s policy, West said, has been to protect lives and livelihoods through the pandemic, and chart a sustainable future.

“This Government has demonstrated that it is not about winning elections. We will make decisions for the good future of TT.”

Saying the fuel subsidy had once been $7 billion, she said that money could have instead been spent on young people, healthcare and fixing roads. West disagreed with Independent Senator Anthony Vieira’s view, voiced on Wednesday, that the budget had not offered hope.

She said, “It is not because the Government isn’t doing anything, but because of the naysayers.”Likening critics to a children’s fictional character, she scoffed, “Like Chicken Licken, every day the sky is falling.”West hailed the budget’s measures of the housing and village programme, GATE, manufacturing tax credits, energy-company tax breaks, plus “a slew of programmes” for youngsters under the Ministry of Youth Development and National Service.

West then said a work-from-home policy must be carefully crafted by considering an array of factors, via consultation including with trade unions. If not done properly, she said, it could have disastrous consequences.

Citing Justice Frank Seepersad’s call for a reform of service commissions, West said the Government could not rely on opposition support to do this but would still address it. Noting an abundance of caution by permanent secretaries, she hoped to promote better risk assessment and responsible risk-taking among them.

She promised a performance evaluation in the Public Service, starting with permanent secretaries. West noted the unusual situation that permanent secretaries report to their minister but the latter has no input into their assessment.

She said only the permanent secretary to the Prime Minister has input in assessing other permanent secretaries via his/her role as head of the public service, but she then said this latter post does not actually exist formally. She promised a rationalising of the position.

Lab technologist recording test results

The Health Ministry is advancing efforts to digitise its records with installation of an Electronic Medical Records system soon.

Health Minister, Dr Frank Anthony said the system which will create more efficiency in the sector, should be implemented by this time next year, beginning with hospitals.

“There are numerous advantages to going to an electronic system. One, we can be able to store large amounts of data, retrieve it, readily and have all the patients’ records in one place, but it’s also very convenient for both patient, doctors, medical staff and so forth,” Dr Anthony said.

A working group has been established within the ministry which has collaborated with the Mount Sinai Hospital in New York, to design the electronic patient record system.

“What we envisage with such a system is that the patient when coming to the doctor, records will be available to that person, and if they go to the lab and they do a lab test, they don’t have to go back to the lab for the results. Those results would be integrated into their patient records. If they go do an x-ray or a CT scan, that imaging would also be integrated into the patient’s records, so when you go to visit your doctor all your information is available,” the Health Minister said.

This, he noted, would reduce waiting time, and save patients a lot of hassle.

Doctors will also be able to access patients’ records, quickly and when a diagnosis is made, a prescription for medication will go directly to the pharmacists to dispense medication to the patient.

This is just one of several measures the Health Ministry is taking to create a more efficient healthcare system in Guyana.

Maradona ‘Hand of God’ World Cup ball to be auctioned Loop Jamaica

Black Immigrant Daily News

The content originally appeared on: Jamaica News Loop News

The ball used when Diego Maradona scored his “Hand of God” goal against England at the 1986 World Cup has been put up for auction by the Tunisian referee who was in charge of the game and missed football’s most famous handball.

Graham Budd Auctions said Thursday that they expect the 36-year-old Adidas ball, which referee Ali Bin Nasser owns, to fetch between $2.7 million and $3.3 million when it goes up for sale in Britain on Nov. 16, four days before the World Cup in Qatar kicks off.

The goal that gave Argentina a 1-0 lead in the quarterfinal against England in Mexico City has become part of World Cup legend. Maradona jumped as if to head the ball but instead punched it past goalkeeper Peter Shilton. England players protested to Nasser but the goal stood. Maradona quipped afterward that it was scored “a little with the head of Maradona and a little with the hand of God,” leading to its iconic name.

Maradona used the same ball, the only one used in the quarterfinal, for his brilliant second goal four minutes later. The Argentina great ran 68 metres from his own half and weaved his way past half the England team before slipping the ball past Shilton. That goal was voted the World Cup Goal of the Century in 2002.

Argentina won the game 2-1 and went on to lift the World Cup, and the tournament launched Maradona as one of the game’s greatest players. Maradona died in 2020 at the age of 60.

“This ball is part of international football history,” Nasser said in a statement from Graham Budd Auctions. “It feels like the right time to be sharing it with the world.”

The shirt worn by Maradona in that game against England was sold for $9.3 million at an auction in May, which was at the time the highest price ever paid at auction for a piece of sports memorabilia. The record was beaten by a 1952 Topps Mickey Mantle baseball card, which sold for $12.6 million in August.

Nasser will also auction the referee shirt he wore for the quarterfinal, Graham Budd Auctions said, and another shirt that Maradona signed for his “eternal friend” at a reunion years after the game.

Visitation ban to be lifted at Infectious Diseases Hospital

The Ocean View Hospital

The Health Ministry will be lifting the visitation restrictions in place at the Infectious Diseases Hospital as early as next week.

Speaking during today’s COVID-19 update, Health Minister, Dr Frank Anthony said there are few COVID-19 patients at the institution.

The hospital is also now accommodating patients with other infectious diseases.

“The majority of patients that we have there are for other diseases. We have taken a decision that we are changing the visitation rules because when we only had covid-19 patients, we were not allowing people to visit patients in the hospital, so we are changing the rules, we will be allowed visitation,” the Minister noted.

The Health Ministry will lay out the ground rules for visitation in the new week.

Minister Anthony said there are several other infectious diseases in Guyana which may require hospitalisation.

In that regard, persons visiting the facility must meet some requirements.

Persons will be required to wear Personal Protective Equipment (PPE) which will be provided by the hospital.

“So, there are several infectious diseases that we would normally work on and unfortunately some of the patients would require hospitalisation. So, in cases of TB, for example, some of these patients require hospitalisation and we have been using the facilities that we have at ocean view to hospitalise some of these infectious disease patients…So that’s why anybody who is coming there should take protective measures. When we open it up, we hope that the general public would cooperate with us,” Minister Anthony stated.

Dr Anthony announced too that the requirement for persons to do PCR tests before surgery has also been lifted.

“This is just an additional requirement for them to know maybe the status of the patient, but what we found sometimes it has become now a barrier preventing people from accessing surgery that has been planned, causing numerous delays and so forth. So, we think that we can change it, make it easier for these patients who require surgery to be able to access that surgery,” Dr Anthony said.

Over the last 24 hours, there have been four new cases of COVID-19, with 51 active infections.
