Former Minister of Works charged in Magistrate’s Court

BELIZE CITY, Wed. July 27, 2022

The Commissioner of Police, Chester Williams, in an interview this morning said that he was told that former Minister of Works, Rene Montero, who represented the Cayo Central constituency during the previous Barrow administration (UDP),  was “on his way” to Belize and would be handed over to police by his attorneys upon his return to the country. He further noted that police had been informed by Montero’s attorneys that he would be answering to the charges of “willful oppression” brought against him. And he stated that as soon as Montero was turned in, police would be proceeding “with the matter against him”. It is now being reported that Montero has in fact re-entered the country and was arraigned today in the Belmopan Magistrate’s Court, where he met bail of $20,000. The matter was reportedly adjourned until October 24.

Montero, who reportedly arrived at the Philip Goldson International Airport on Sunday evening at 5:00, reportedly had to surrender his passport after receiving bail. 

In September 2021, a warrant was first issued for the arrest of Montero and one George Andrews. It called the former Minister of Works to answer to charges under sections 284 and 309 of the Criminal Code. That section of the law states, “A public officer…is guilty of wilful oppression…if he wilfully commits any excess or abuse of his authority to the injury of the public or of any person.”

Subsequently, on April 25, 2022, it was reported that a Red Notice, which had a publication date of March 2, 2022,  had been issued by the International Criminal Police Organization (Interpol) for the detention of Montero, Sr., and had deemed Montero an escape risk. An AMANDALA article dated April 25, 2022 had reported, “Police have sought—to no avail—to detain the former Minister on the charge of Willful Oppression after it was found that he had willfully abused his authority. According to Belize’s Constitution, any public officer or juror found guilty of the aforementioned crime is liable to be sentenced to two years of imprisonment.”

The Red Notice, which had featured Montero’s photo and listed other details that could be helpful in identifying him, had indicated that, upon the former minister’s arrest, immediate extradition would be sought.

Montero, who served for 12 years under the Barrow Administration, first became the possible subject of a criminal investigation in January 2021 after Minister of Infrastructure Development and Housing, Hon. Julius Espat made a complaint to the Belize Police Department about what he referred to as Montero’s “prolonged abuse and misuse of public resources”. It is being alleged that Montero used public resources, including expensive equipment belonging to the Ministry of Works, to develop properties that belonged to him and his friends and family members. Within a month, a police report had been delivered to the Director of Public Prosecution (DPP), the Integrity Commission, and the Commissioner of Police for review. A few months later, in September, police issued an official warrant for Montero’s arrest.

Following the issuance of the warrant, the chairman of the United Democratic Party had dismissed the charges as unfounded and as an attempt to embarrass the former minister. He had further indicated that Montero had not fled the country, as had been reported, but was in fact visiting the United States for medical reasons and would be handing himself over to the police upon his return to the country.

“Rene Montero called me from the United States yesterday and said that he’s there for medical purposes and as soon as he’s done with that he’s going to come right back and face some willful oppression, some obscure charge in the Criminal Code that says that sometime between 2016 and 2020 he committed willful oppression,” Peyrefitte had said.

One of Montero’s attorneys, OJ Elrington, had stated something similar—that the effort to locate and arrest Montero was just “political mischief”.

However, an AMANDALA article dated April 25, 2022 had reported, “Even long before an official complaint was made against Rene Montero, Sr., reports of his misuse of public equipment had already begun to circulate. In one instance, it was alleged that a number of Government-owned equipment, once believed to be missing or stolen, had been confiscated from one of Montero’s properties. And in another, a former associate of the ex-minister appeared on a Plus TV morning show with photos that purportedly were evidence of the use of government equipment on a private farm. At that time, both Montero and his son, Rene Montero, Jr. had maintained that all the allegations being made against him were false.”

The alleged offenses are believed to have occurred between April 14, 2016, and November 12, 2020, the day after the last general election.

Today, Police Commissioner Williams said that Montero may face justice shortly. At the time that Minister Julius Espat had first made the allegations against Montero, it was said that the criminal code sections under which the charges were being brought, actually applied to public servants and not elected officials. COMPOL Williams has indicated, however, that he disagrees with this interpretation.

“From my understanding of the law, the charges are appropriate, and we are going to see what happens in the court. It’s not a matter for me to decide the guilt or innocence of Mr. Montero, it is to happen for the court, and so the seasoned attorney, if he is going to be the one that will represent Mr. Montero, will have his day in court,” COMPOL Williams said.

USA-bred EROY and fellow American RUNAWAY ALGO square off in an epic clash at seven furlongs for Saturday’s Caymanas Park feature, the Eros Trophy, the ninth of 10 races scheduled.

Speedy RUNAWAY ALGO was caught close home by I’VE GOT MAGIC when hunting a fifth straight win on May 22. The quick three-year-old will try making all but faces a tough foe in experienced four-year-old, EROY, who won second-time out off a six-month lay-up, a fast-time victory at seven and a half furlongs in the Hubert Bartley Memorial on June 26.

Dale Murphy’s RUNAWAY ALGO has been burning up the exercise track, clocking 1:28.0 and 59.3 for seven and five furlongs, respectively, galloping out the mile chute.

Dick Cardenas, who was aboard Richard Azan’s EROY for his easy win, has opted for RUNAWAY ALGO, no doubt impressed by the three-year-old’s exercise form.

However, EROY won by 10 lengths with topweight 126lb, clocking 1:31.0, a second and two-fifths faster than I’VE GOT MAGIC’s win against RUNAWAY ALGO. EROY, who won in sloppy conditions, also returns seven pounds lighter, sitting level with RUNAWAY ALGO at 119lb.

EROY’s flashy performance was underlined by top-class MAHOGANY’s 1:30.2, six days later, on a good track, running nine pounds lighter at 117lb.

LIVERPOOL, England (AP) — An Everton fan who has been helping Ukrainian refugees was brought on to take a penalty during the Premier League team’s preseason match against Dynamo Kyiv.

Paul Stratton, a 44-year-old Liverpool municipal worker, has traveled to Poland to deliver supplies to refugees fleeing Russia’s invasion of Ukraine.

Stratton, in full Toffees uniform, came on as a substitute toward the end of Everton and Dynamo’s “match for peace” at Goodison Park on Friday night.

Everton manager Frank Lampard gave him instructions on the touchline before Stratton tucked away his penalty. Stratton then ran toward the stands to celebrate and was congratulated by Everton players.

The goal didn’t count and the game finished 3-0 in favour of Everton. The match was broadcast live nationally in Ukraine, the club said.

Proceeds will go to humanitarian charities supporting the people of Ukraine.

This was the first “match for peace” in Britain. Dynamo have played similar games in other European countries since the start of the war.

The crowd included 2,000 Ukrainian refugees who have been resettled in Merseyside communities. They were given free tickets.

REAL NEWS- Harold Lovell is decrying the aggressive position that Prime Minister Gaston Browne has taken in the matter involving the collapsed British American Insurance Company Limited (BAICO) and Colonial Life Insurance Company Limited (CLICO) and promises by the Government of Trinidad & Tobago to pay local policy-holders.

Browne is threatening to sue the T&T Government over its failure to pay the US$60 million balance on a US$100 million commitment.

The Prime Minister, in his usual fashion, made the announcement on his affiliated radio station – rather than on State media – on Saturday, July 23.

Lovell, the Political Leader of the United Progressive Party (UPP), says the Head of Government lacks diplomacy.

Lovell, an attorney-at-law, says the payment promised by the T&T Government was not an official court order; rather, it came about after months of negotiation. This is what is now needed, Lovell says: a meeting at the table.

The Political Leader says the Browne Administration may have an uphill battle litigating this matter.

BAICO and CLICO – a Trinidad-based conglomerate, went into insolvency in 2009, leaving Antigua and Barbuda policy-holders among those still owed millions of dollars.

The Government reportedly is pursuing litigation against the principals of the insurance companies.

Meanwhile, PM Browne said he hopes that Trinidad & Tobago is benefitting from the increase in fuel prices and therefore will put some system in place to cover the rest of its liability.

UPP leader concerned over gov’t efforts to gain more control of ECAB

OBSERVER: Leader of the United Progressive Party (UPP) Harold Lovell has given Prime Minister Gaston Browne a failing grade for the “unacceptable” manner he has been dealing with the ECAB shares conversion saga.

Last week, PM Browne blasted the directors at the regional bank, claiming they were dragging their feet on allowing the government to attain ordinary shares in the financial institution.

Government has 25 percent preferential ownership in ECAB and gets the first claim on the distribution of profits, but it is restricted to voting only on resolutions that directly affect its rights.

More than three years ago, the government wrote to ECAB’s board of directors asking to convert its shares to ordinary shares, which would allow the government to claim full voting rights in key decision-making processes.

But that has still not happened, delaying the government’s intentions to sell citizens some of its ownership in the local bank.

Together with ACB, which owns 15 percent of ECAB, local shareholders will account for 40 percent of shares, and voting power in the institution, if the government is successful in acquiring the ordinary shares.

However, Lovell said Browne’s handling of the matter is inappropriate.

“The way in which he has accosted the board is unacceptable. You don’t do that as a prime minister,” the UPP leader said.

He also expressed concern that PM Browne is pushing to gain more control of the bank.

Lovell, a former finance minister, said the banking sector should be protected at all costs so as to prevent any possible corruption or collapse.

“A bank is the only business where the stock does not belong to the owner. It’s somebody else’s stock and you need responsible management of that stock,” he said.

“We have seen banks go down because you have governments which are broke and will be tempted to simply call up and say ‘I need 10 million dollars and you must send it to me’. And that type of pressure that we have seen the prime minister exert now, you can imagine what will happen down the road when the government needs money.

“We have to be very careful because we have to look about the interest of depositors. Your money is in there and you need responsible management of that money and what will eventually happen is that the government, yes, will be in a position of control but can we trust the Gaston Browne government to simply allow the bank to be run in a professional way or will there be the temptation to say ‘we need money, give us money and if you don’t, we will pressure you until you do’?

“That’s a very dangerous situation,” Lovell added.
